SICKLES’ STATUS. ‘The Question of the Right of a Retire@ Army Officer to Sit in Congress. ‘The election to Congress from the tenth dis- trict of New York of Gen. Daniel E. Sickles has revived the question as to the right of an ofi- cer on the retired list of the army to a seat in Congress, in view of the constitutional provision ‘no person holding any office under the United States shall bea member of either House of Congress during his continuance in office.” When this question first arose on the nomination of Gen. Sickles it was unoficially presented for an expression of opinion to the Attorney General, the law officers of the army and the accounting officers of the treasury, but each and all of them declined to commit him- self further than to say that it was a question for the House of Representatives alone to settle under its constitutional authority to determine the qualification of its own member. The only question involved is whether « re- tired army officer holds an office within the meaning of the Constitution. The consensus of opinion among legal officials on this point is in the affirmative. ‘There is not even a probability, however, that any official of the executive branch of the government sill atiompt to interfere in anyway with the seating of Sickles. Therefore unless some member of the Houce itself shall make objection he will ¥e allowed to disc! his duties as a member of the national ture without the necessity of relinquishing his standing and emoluments as a retired army officer. ——-2——____ He Did Not Come on Deck. The democrats seom to have gained # Sen- ator in California as well as one in Wisconsin and one in New York. If it stands there they will tie the republicans, giving the populists the balance of power. Stewart of Nevada will be returned as a silver man imply, and be hae abandoned the republican party and will act with the democrats in the organization of the Senate. The populists appear to have gained the Sen- stor in Wyoming. Kansas, it is believed from the returns received bere, will give the Popalists another Senator, though it is not ware, f it does Jerry Simpson, who ix an out-an: out free trader, will vote for the most extreme tariff reduction the democrats can propose, Kyle and whomever the populiste elect in Wyoming will vote with the democrats on the tariff. In the House the democrats will probably ¢ a majority of 110, having about £30 mem- bers. From this it appears evident that the new administration will bave the opportunity to put its tariff scheme into effect and wilibave to take the full responsibility for what they do or fail todo. ‘There will be no opportunity to ‘ay that they want to do 60-and-so, but that the Senate stands in the way. 4 SHADOW ACROSS THE PATH. But there is a shadow across the path. They Will do well if they can avoid getting into fight among themselves over the question of how far they sball go in cutting the tariff. ‘There will be many men in the House who will rant to go much further than will Mr. Cleve- lan The organization of the House willbe fevor- able to Cleveland's ideas. Crisp will, beyond question, be the Speaker. He and Cioveland agree on the tariff. There will be a mall fac- tion who will not be satisfied at anything short of the burning of the custom houses and another small faction who will not want to muke as heavy reductions as will Cleveland and a ma- jority of the democrats, and they are liable to we amonkey and a parrot time over the schedules when the time comes. With uch « tremendous majority in the House it will be difficult to preserve harmony — more difficult than in this Congress, for the reason that the policy of this was to undertake but little, as nothing could be accomplished. In @ Congress where their actions count individual opinions will be more pronounced. DIFFERENCES OF OPINION. The chances are that the House will be mere radical than the Senate on the tariff. It may be difficult for the democrats in the House to act harmoniously, and there may in the Sen- ate itself be a considerable difference of opinion between Mr. Hill and Mr. Gorman on the one hand and Carlisle and Mills on the other. The most devoted democrat cannot conceal from himself the fact that the party hase big contract before it and that it will take great wisdom to save them from serious difiiculty. The money question is going to give them trouble, but {t iw pretty wafe 10 any that Cleve: land will dominate the party in that, though not without friction. The one thing that all the democrats will agree on is the repeal of the federal election laws. The federal authority over elections will be reduced to a minimum.
