As stated in Tur Stan, the United States Supreme Court yesterday decided in the case of Wm. D. Cross, the colored wife munierer, tat it bad no appellate jurisdiction of capital cases tried in the District of Columbia, Mr. Chas. Maurice Smith,of counsel for Cros, stated to a Stax reporter this morning that be had not yet read the document, but understood that the court's decikion was based alone upon the ground that persons #0 charged had, in the District Conrt in General Term, the benefit of an appellate court, and that there existed no Inw authorizing the United States Supreme Court to act in the eapacity of a second appellate court. Mr. Smith thonght” the court hed. entirely failed to notice the contention of counsel for ‘Cross that the Supreme Court of the District was a United States court in the meaning of the act of 1889, and that therefore #nch an appeal should lic from it to the Unit States Supreme Court. The decision, a* be under- stood it, was based upon the suggestion of the solicitor general that one convicted of @ capital or infamous crime in this Dis- trict had no right to have his appesl from the trinl court passed upon in two appellate tribunals, It appeared to him that the court's decision evidenced more than anything cle @ determination that its already overburdened docket should not be further enlarged by the aliowance of such ap peals, Mr. Smith ¢tated that at presont he was not Prepared to state what further steps Would be taken in the case of his client. Everything possible, however, would be done and every legal right and privilege ex- ercised, as he believed Cross was an innocent man and that he had been unjustly convicted. That is, provided his counsel should that some constitutional right of the condemned man bad been violated. it can be stated that Schneider is much improved in health, and that he is fast regaining his customary good spirits. His appetite is much improved, and no fears whatever are now entertained by the prison officials us to Schneider's condition. It 1s said that he feels very hopeful of obtaining « new triul and ultimate acquittal, ey - DEATH OF COL. E. H. LEIB. Brief Mention of the Brilliant Record of One of the Most Gallant Union Soldiers. The death of Lieut, Col. E. H. Leib at Mil- lersburg, Pa., this morning removes one of the most gallant soldiers in the late war. Reporte made to Congress show that Col. Leib entered the service as a private soldier in the Warhing- ton artillerists of Pottaville, Pa., the first com- pany of troops to reach the seat of government after the President's call for 75,000 men. This company artived here one day in advance of the Massachusetts wixth. On April 26, 1861, he was commissioned a second lieutenant m the second United States cavalry (now the fifth United States cavalry) and was a participant in the first lmttle of Bull Run. He was in com- mand of company F of his regiment at the sioge of Yorktown, in the battler of Williams- burg, Hanover Court House and throughout the Beninoula campaign, For gallantry at “Old Church,” Virginia, he received warm com- mertiation from Major General Emory, his superior commander. He participated in all the “Seven Days” battles in front of Richmond, and in the engagements of the Maryland cam: paign which succeeded. including South Moun- tain, Antietam, &e., closing at Predericksburg December 13,'1863. He sccomy Gen. Stoneman in hix raid around Richmond, May 1863, and served in all the engagements and suber charges against the enemy, and for hie gallant service was promoted to the rank of in. In April, 1868, be served in the Peun- sylvania campaign. was present at the historical battle of Gettysburg and all of thone imme- dintely preceding and succeeding it. and for his good conduct throughout was highly compli- mented by Gen. Pleasanton, He likewise par- ticipated in all campaigns and battles in the Shenandoah valley under Gens. Custer and Sheridan. At the battle of Five Forks he received a gun- shot wound, which entered the upper right arm and passed ‘through the body, injuring the longs and producing dimbility that resulted in paralysis and finally caused hix death. On account of said wounds and dimbility be was granted a pension by the government. He was the recipient of many promotions and honorabie tertimonials from his command ing officers for his gallant and meritorious con- duct in more than fifty battles in which be was fa 1864 Col. Leib wan stationed at Paltimore at the time of the invasion by the confederate Gen. Early. He offered his services to Maj. Gen. Wallace and they were accepted. He was in the battle of July 7 at Frederick, Md., and brought up the rear guard on the Sth to Monocary Janction. On the 9th he was ordered to take command of the 100 days’ regiments of infun- try and to hold the Baltimore pike bridge cross ing the Monocacy. He fought his command all day and lost » great number of men, but suc- ceeded in holding the only road that Gen. Wel- luce had to fall back on. “The gen ral states this fact in his report of operations, Finally Col. Leib brought up to Baltimore the rear guard of our routed army. On the 18th of July he was appointed inspector and chief of cavalry of the eighth army corps, and went to ‘Washington with Gen.
