In the Court in General Term yesterday the case of the Union River Logging Railroad Company against Secretary of the Interior Noble and Commissioner of the Land Office Carter was argued by Messrs. Phillips and Me- Kenney for the complainant and Assistant At- torney Maury for the respondents. The com- plainant is ® corporation of Washington and they claim they constructed a railroad, and in 1889 it filed in the land office at Seattle the necessary papers under which they were en- titled tothe benefits of the act of March 3, 1875, as to right of way over the public lands, &c., and they were transmitted to the commis- sioner of the land office and they were ap- proved by Secretary Vilas January 29, 1889, In June, 1600, an order was iosued by Secre- tary Ne I. ‘complainants t to show cause ny the previous approval should not be annulled. The complainant protested that the revocation was beyond the power of the Sec- retary, but answered.
