THE EVENING STAR has a requiar and permanent circulation in Washington three times larger than that of any other paper tm the city. As a loeal NEWS paper and Advertising Medium it hae ne competitor, ——— ‘The New York Times prints @ cock-and-bull story to the effect that the District of Oolum- Dia will east its powerful influence in tho speakership contest for Mr. Crisp, in order to seenre the appointment of Mr. Hemphill as chairman of the District commit- tee, and the most effective promotion of seliish and hungry local interests by the District's legislature. The District as well as the Times and the republic nt large thoroughly appreciate how much the city’s de- cision upon this question means, and how cora- pletely the fate of candidates is trembling in the balance which we hold, and for this reason the District is especially sensitive to ridicu- Ions misrepresentations of its attitude in the speakersaip fight. It is not true, then, that we of the District have decided to elect Mr. Crisp Speaker. We have not yet finally ecttled the mstter. Both Mr. Mills and Mr. Crisp are very popular here, admired and respected by the whole community, and the other candi- dates are not by any means friendless. Nor is it true that to secure Mr. Hemphill as ebairman of the District committee it is necessary to relect Mr. Crisp as Speaker. Mr. Hemphill bas heretofore been an able, upright and acceptable chairman of that committee, and was the recognized democratic leader upon it im the last Congress. No matter whois chosen Speaker the chairmanship of that committee would naturally be tendered to bim, and the danger thatthe District may not have the Denetit of his services in that capacity springs not from a particular result of the speakership election, but from his own possible aimbition to occupy more prominent position from the national standpoint in the composition of the committees of the next Hoase. If the District were convinced that Mr. Hempbili would certainly be the chairman of its committee under Mr. Crisp and would not be underany other Speaker, itis very likely that Washington would require the House to elect Mr. Crisp. But as matters stand, it is confi- dent that it will find, in the presiding officer of ‘the lower branch of its legislature, a very good friend, no matter which of the candidates named is chosen, and consequently it most probably will not interfore with the selection of 8 Speaker by the representatives of tho nation at large in Congress assembled. Since Congress is the District's only legis- lature this community is not unnaturally con- cerued in the acts of this body, especially in the make-up of the local committees, through which most of the necessary local legislation ie obtained. It is essential for the welfare of the city that ite legislative affairs shall be regu- lated by men of intelligence and probity, who are acquainted with and friendly toward ‘the capital. It isabominable that the slight- est show of interest on the part of the citizens in what so vitally concerns the capital should failingly elicit newspaper romances, pic- turing the community as conspiring to cor- ruptly influence the Congress of the United States. Newspapers of respectability ought not to give circulation to these anonymous slanders, the work of ignorant or malicious miscbief-makers. + The celebrated Beriug sea question is squarely before the Supreme Court and two days’ ar- gument has been heard. The public interest in this famous case justifies all the considera- tion it receives. It is well known that it came before the supreme judicial tribunal of the re- public on a motion for a writ of prohibition to stop the Alaskan court from enforcing its de- cree against the owner of the Canadian schooner Sayward, whose vessel was overhauled in catch- ing seals within Bering sea in contravention of a law of Congress. It will also be remembered that the preliminary plea of the United States, that the Supreme Court could not even enter- tains motion for leave to file « petition for writ of prohibition,was overruled. The present hearing involves the question of jurisdiction, and, as stated by the solicitor general, the juris- diction of the United States asa political question, the decision of the executive and Congress being conclusive on the Supreme Court iteelf and every citizen within the limits of the country. The reason for the position taken by the solicitor general is that in determining that political question the President is dis- charging his constitutional functions, and in auch discharge of duty is not an inferior ‘tribunal whose decision may be reversed by the Supreme Court. This may seem to some peopie an alarming doctrine, but is defensi- ble on the ground of a long line of precedents too numerous to mention, precedents not con- fined to any one party or any one school of constitutional construction. The departments of the government are co-ordinate and of equal dignity and power, with no inferiority in the politieal to the judicisl. The President is sworn to administer the laws, the federal judi- ¢iary to construe them. In thismatter the juris- diction seems clearly one of the political power. Otherwise the Supreme Court, and not Congress and the President, would define the geographi- cal limits, and, therefore, the political jurisdic- tiov, which in effect would be to make the fed- eral Judiciary supreme over the government of the republic—e result never intended by the Wise, learned and patriotic men who framed and ratified the Constitution. The ennounce- ment that the executives of the two nations have agreed upon an arbitration of the ques- tions at issue by a tribunal whose decision shail be binding upon both parties emphasizes the objections to the conversion by Great Britain of our Supreme Court into the umpire in a jug-handled arbitration of a political ques- tion, whose decision will bind the United States, 3f unfarorable to our contention, but will not bind Great Britain if the opposite decision is reached. The present administration bas made an ad- mirable record in many respects. It has proved itself clean, strong and fntelligent, and as pfoof conclusive on the last point it seemed to show by its foreign sppointments a proper appreciation of the press of the republic. But ‘Within the last year, while maintaining the ap- Pearance of a friendly disposition toward the American newspapers, it has played upon them @ game which they despise by “scooping” on two important cecasions the whole journalistic fraternity.
