The decision of the Supreme Court upon the preliminary question in the Sayward case dis poses of the technical point that the Alaskan court is not “a district court of the United States” and that the Supreme Court cannot issue a writ of prohibition to it. The court decides that it has the power to issue this writ on a proper showing, and gives the British government the opportunity to make this showing. What Great Britain gains by the on is the chance to be heard. Apparently there is still oppor- tunity to contend that the record of the proceedings of the Alaskan court is such that its jurisdiction cannot be questioned, no mat- ter what the facts may be. Unquestionably the decision has not discredited or weskened in any respect the force of the contention that the extert of the dominion of the United States in Bering sea, which is the point xt issue, ix a po- litieal question to be decided im conformity with the decision of the political departments of the government. Great Britain ix to be beard, but there is not the slightest indication that the Supreme Court when it comes to de- cide whether or not the writ shall issue will not adhere to the precedents and rule of common sense which bind it to follow the conten- tions of the executive and legislative depart- mente upon questions of national jurisdiction in controversy with foreign governments. The main interest of the United States government is to prevent a dcbision by the Sapreme Court upon the merits of the question which ehali put two of its departments at loggerheads. Since a decision of this court sustaining the American diplomatic contention would not bind England, while an adverse de- cision would weaken, perhaps overthrow, the contention of the American political depart- ments, nothing but disadvantage can result to us from the consideration of the merits of the controversy by oar supreme judicial tribunal. ‘The court after it has heard the argument may refuse to express its own views upon the merits of the controversy, sustaining the American position on the ground that the question in- volved is political, ane has already been decided, #0 a8 to bind all branches of this government, by ite political departments. John Bull has been told that he may have the opportunity to propose his new game of “heads I win, tails you lose,” but it does not follow that Uncle Bam is going to play it ns While Tux Srau has favored the apportion- ment bill on grounds not connected with the size of the House of Representatives, it has op- posed further increase of membership on gen- eral principles. The joint resolution of Repre- sentative Brosins of Penneylvania preventing an enlargement beyond the figures provided in the new bill, might well be adopted and sent to the states for ratification, though the «me con- siderations which have heretofore resulted in the steady inerease of membership will proba- bly operate to defeat it. The House is already unwieldy in size and has gnined in membership with each recurring decennial period. More and better legislation is done by comparatively smail bodies than by very large ones. A peo- ple’shouse should not be so small as to bea bat it should also not bea tumultuous and unwiely ‘The North Carolina Farmers’ Alliance wants the state to issue ten millions in four per cent bonds, sell them at par and loan the proceeds to real estate owners at two per cent, the other two per cent due the bondholders to be made up by taxation, which would add only $200,000 to the present taxes. The bonds are to run thirty years. The scheme would give $100,000 to each of the counties. They must want money down there, to be sure, to mortgage their homes and thirty years of the future to get it. One theory involved in the proposition is that it is easier to pay for borrowed money im taxes than in interest ——__—+2—___ The United States government wants one thousand two bund-ed men to serve as sailors, does it? Senator Turpie in a speech yesterday introdre- inga joint resolution providing a constitu tional amendment to effect the purpose said ‘that both the Senators from Indiana favored the proposition. It is also known that the popular election of Senators is approved by at least four western states whose legislatures have declared themselves. An clection by the people directly would prevent some evils doubtless and would not introduce any new ones if the long term were retained. —— a The conservative or governing party in Spain seems to know how to hold the country. At the recent elections, although Castelar in Hues ear and Zorilla in Barcelons were re-elected, some other republican leaders were defented, and 20,000 republican votes at Madrid were insufficient to elect a single member of the Cortes.
