With the bill of exceptions is filed the teati- mony taken at the trialund alsoaclaim of newly discovered evidence, so that counsel | base their motion for a new trial on several grounds, which will no doubt require extended arguments. The date fixed for the execution of Cross is January 9, but itis not unlikely that further time will be granted, as the case has not yet been argued and a decision is not likely to be renddred before that date. Coun: confident that when the facts in their pe get before the court their client will be given a new trial. STORY OF THE CRIME. ‘The case was a peculiarly interesting one on account of the defense set up that the woman took her own life. Cross, it is remembered, lived on Sth street southwest, and on the night the fatal shot was fired he started from home to go to the theater. His wife wanted to go with him, but he declined to take her. He left the honse alone and she followed him to 7th and C streets, near the Baltimore and Potomac railroad tracks, and there the fatal shooting oc- curred. The pistol was found beside the body of the dying woman and the defence claimed that it was her weapon and that she killed her- self, probably from jealousy. Cross has been aqniet and obedient prisoner in jail and he still protests his innocence. ee The Potomac Literary Club.
