An extension of the supreme tribunal would hardly meet the requirements unless the court w divided into sections, and in the Judgment of many lawyers this would be of doubtful expediency if not constitutionality. Aa intermediate appellate court, the other courts retaining their present powers, would be ® modification of the system beyond what seems necessary, although it has bad the in- dorsement of some able jurists and lawyera ‘The conversion of the middie court in the sys tem, the Circuit Court, into an appellate tribu- fal, without original jurisdiction, to hear and decide certain cases not of the bighest import- ance, both preserves the symmetry of the judi- cial system and provides for instantaneous aud most effective re! Whatever method may be adopted the present session should not con- clude without the enactment of some menaure to relieve the pressure upon the Suprem Court ——— The delay of justice in the Kemmler case has apparently produced a revulsion of the public mind in New York in favor of the abolition of eapital punishment. If the bill to abolish cap- its] punishment for murder becomes a law and operates largely to imerease the number of mur- derers,there will be a further change of opinion the other way. The popalar instinct is to jump at conclusions, At present stern justice is at a ciseount, pot so much because people are sentimentalists as because the law that is on the statute books is so liable to be defeated by le- gal technical procedure. It is stated—and the fuil numbers are pnblished—that only one- twenty-seventh of American murderers in the last six years have been put to death by tho Jaw, while one-fifteenth have met swift retri- bation out of the lawful way, that is, by lynch law. ___—————— When the Columbus Park bill comes again before the House on the motion to reconsider the vote by which it was rejected it is hoped and believed that second thought will convince some members that they were wrong in their action of last week. The majority against the bul was smail in @ thin House and it is very clear that the question was not understood fully by the House. If the park is to be ob- tamed the laud at least must be secured now, and the city appreciates fully the advantages of a park of the kind proposed.
