2BE EVENING STAR ‘bas the fullest Local Cireulation of any Newspaper in the World, end as an Advertising Medi: is worth The Baltimore and Ohio railroad needs addi- tional freight facilities and condonement of its Past offenses in the illegal occupation of and use of public property. The Baltimore and Potomac railroad stands in need of precisely the same relief. The former, in seeking these concessions from the public, proposes the improvement of its occupation in certain par- ticulars. It offers to remove its present main line from the city entirely, join its two branches outside of the city, bring them down a single street, and build expensive bridges at three points on this street. It is evident, moreover, that additional concessions for the public benefit will be exacted by the Senate committee. The Baltimore and Potomac road, on the other hand, in ask- ing the enumerated concessions for its own benefit, proposes no improvement whatever of its occupation. It makes in the House a direct and unconditional demand for what it wants, with no suggestion of a reduction of its sur- face tracks or of any concession of any sort to the public. It places itself in a much more discreditable attitude than does its competitor. Why should Uncle Sam forgive and pet one of these offending corporations without the atone- ment which is exacted from the other? Will the House District committee give to one of these roads the things which it wants without coupling with the grant sat- isfuction of the needs of the public in respect to the railroad occupation? Will it be less watchful of the interests of this community, over which it exercises a guardian's supervis- ion, than the Senate committee? Washington understands very weil that it must get rid of grade crossings in connection with the grant of these concessions to the railroads or not at all, and thata grant of the corporate relief, not coupled with the provisions for tho benefit of the people, is a denial of public relief. a The decision of the Court of Claims, speak- ing through Judge Davis, gives great satisfac- tion tu those members of the House of Repre- sentatives who are affected by the Silcott de- faleation. Only the loss of the November salaries is covered by the court's opinion, but this will probably be sufficient basis upon which to legislate an appropriation bill paying back the entire amount of salaries for the year actually stolen, The decision goes on the sround that the custom of the House and var- ious acts of Congress, including one of June 22, 1832, and the appropriation measures, all tacitly recognize the sergeant-at-arme as a dis- bursing officer of the goverment. Referring to the statute of '82 the court says that it re- fers to some offi ers not named but recognized as in existence, and as having power to dis- burse the money appropriated for members’ salaries; that officer did in fact exist in the sergeant-at-arms, Whether at the outset he was legully authorized to perform the duties in fact imposed upon him becomes now unim- portant, as the statute of ‘82, interpreted by the rule of "+0 and the situation when the statute was passed, contains a legislative declaration of the power assumed by Congress then to exist in this officer—a declaration suffi- cient to operate upon him in the future and to constitute him thenceforth in law what he had jong been in fact—if not in law—a public agent charged with the duty of paying the salaries of members and delegates. The de- cision appears to remove all rational doub: as to the rizht of the members to be repaid out of the Treasury. —— Prevention of crime by fixing rational deter- rents therefrom is better than punishment after commission. The criminal, in the first place, is to be caught, and in the next place he is to be tried. He may never be caught; he may escape merited punishment by the law's delays or the corruption of prosecutor or jury or the incompetency of the judge; there are, in fact, several loop holes for a person who is guilty, Itis betterto fix a punishment that can be inflicted, which the sentiment of the community will uphold, for the acts which lead up to the commission of crimes of vio- lence than it is to attempt to suppress these crimes by delaying and inflicting punishment ouly after crimes have been perpetrated. ‘This is the experience of all nations and mu- nicipalities It is common sense that requires noexplanation, Acase in point is the bill against carrying deadly or dangerous weapons, reported in the Senate recently.
