WASHINGTON: Circulation of any Newspaper in the World, and as an Advertising Medium is worth more than all the other papers published in Washington. a ————————— Kew York Office: Room 93, Tribune Building, The absence of the President and his cabinet from the judicial centenary in New York today, due to recent calamitous events in the family of two of the most distinguished of the Secre- taries, will detract somewhat from the impress iveness of the ceremonies on the occasion. But there will be, nevertheless, very much to remind the participants, the American people im general, and lovers of orderly freedom throughout the world, of the progess from an ill-adjusted, wholly insufficient confederation of state governments to a federal republic or- ganized by and for the people of the United States—a government with three great subdi- visions of powers. Of these, the judiciary has not been, like the others, entrusted with cre- ative functions. But the operation of its powers has been the same in effect as if they were creative, The Supreme Court has defined the Constitution in such a manner as to undo mere political revolutions, using the latter Word in its subordinate sense of great but con- stitutionally effected political changes, but the tradition from the beginning has been un- broken, and the animus of the judiciary, bar- ring the slight prejudices inseparable even in judicial minds from human natnre, has been one ofa fair construction of national powers in accordance with the consensus of opinion in the country throughout its history. The names of the illustrious citizens and eminent lawyers who have held the scales of justice since the court was organized is a sufficient guarantee of the patriotic honesty of the tribunal. Count- ing Rutledge, who held the office of Chief Justice afew months, there have been eight Chief Justices—John Jay, of New York; John Ratledge, of South Carolina; Oliver Elisworth, of Connecticut; John Marshall, of Virginia; Roger Brooke Taney, of Maryland; Selmon P. Chase, of Ohio; Morrison R, Waite, of Ohio, and Melville W. Fuller, of Illinois, the Present incumbent. $2 The investigation into the origin of the fire at Secretary Tracy's which destroyed his wife and daughter and came so near to ending his life will not have accomplished any material benefit unless it shall secure for the occupants of residences hereafter to be built greater im- munity from peril. That a handsome house, erected at considerable cost and supplied with all the modern conveniences, should prove a mere fire-trap to ensnare its owner and his family is a serious public concern. Just as this thing happened yesterday it may happen to- morrow and every day unless a wholesome and strict supervision by the public authorities preventa. That supervision is demanded by more than 200,000 people. The lesson of the burning of Secretary Tracy's house is very dif- ferent from the lesson of the burning of the Boston houses last Sunday, to which Tue Star has called attention. In the latter money was not spent to ensure the safety of the occupants. It was a case of pure criminal parsimony. But in the former the residence was turned out to its first owner as a complete job—it was sup- posed to be entirely safe. The public is awakened rudely by this fire with its attendant horrors to the utter insecurity of many of the fashionable residences that are now con- structed at great cost. The feeling is general that we must have closer inspection of all new buildings. The modern city home with its na- merous devices, using electricity as a servant and profiting by all the ingenuity of the Amer- ican inventor, is a marvel of convenience and comfort. But not the same attention has been given to security. Flues and pipes conduct hot air or steam through combustible walls and floors. The wood adjacent to the pipes and flues, which are often defectively constructed, chars and finally takes fire, and the modern Palace becomes a mere fire-trap roasting its occupant with quick flames fed by combustible conveniences and luxuries, Se ‘The constitutionality of anti-Mormon legis- lation has been decided affirmatively by the highest court of appeals in the land. Yester- day the Supreme Court refused the application for # writ of habeas corpus of Samuel D. Davis of Idaho, sentenced for unlawfully taking the prescribed test oath when he was a member of the Mormon church, The court holds that polygamy is a crime and that the constitutional provision guaranteeing freedom of religion is rot intended to prevent punivh- ment of any person who in the name of religion commits a crime in the eyes of the law. This decision is precisely what was expected, The law that Davis violated was framed by the two leading lawyers in the Congress of that time, Senator Edmunds and Representative John Randolph Tucker, It was framed with great care, having the best ideas in it of the two eminent men whose names have been given by the people to the act, ‘The law is not only now established as good law but it is the expression of the people’s will. At the time of its passage through Congress it was clearly seen to be © popular measure, and everything that has occurred since has tended to fix its popu- larity. The legislation was wise because timely and necessary, Un ipesandeees Tue Sram as usual was first in the fleld yes- terday with full particulars of the terrible ‘wagedy at the Tracy mansion, and Tux Sram presses, employes and newsboys had s busy time of it throughout the day in supplying the eager demand of the public. Not since the day that Garfield was shot down has the com- munity been so shocked and thrilled and so eager for definite details of the event, such as Tux Stax supplied. oo The London Times admits that it has libeled Parnell, and pays him $25,000 and costs, The Thunderer will retire for a time from the thundering business. Even an Irish leader eannot be libeled with impunity in England, as the Tines discovers in reckoning its enormous losses in money and reputation. eo All honor to the brave policeman-Cattell and the brave chief of the Fire Department snd his ssswtant, Parris and Wright, for their heroism at Secretary Tracy's yesterday. But for their prompt daring in going into the flames the life of the Secretary would have been lost.
