Lusk’s annual re- port, is, as he states, favored by a strong pub- lic sentiment. The people of Washington are even more unanimously and emphatically of the opinion that the United States should as- sume the entire cost of the attempt to increase the water supply which failed. ‘There is no reason Whatever for requiring the capital to pay a million dollars on the cost of the aban- doned tunnel. The city did not request any such work at its expense; it did not ineur re- sponsibility by having any share whatsoever in the construction of the tunnel. No fault of ita own or of any of its agents caused the work to become a failure, and it has not profited to the extent of a peuny by the construction. It is held under no contract, express or implied, under no obligation, either legal or moral. The mation undertook the work of its own ac- cord, conducted it without any partici- pation in responsibility on the part of the city, and through its own direct agents wasted the moncy with which 1t was intended to increase the water supply. It has the power to collect the expense of its blunders from the defenseless taxpayers of the District, but the exercise of this power in the present case partakes of the nature of a high- way robbery. When Congress has relieved the District of a heavy debt which it has not agreed to pay, for which it has received not the slight- est consideration, and which represents simply the logs from the negligence or misconduct of the government's agents, citizens may attempt to secure with some hope of success a better and fairer apportionment of the expense of supplying the city with water. But if the Dis- trict is compelled by the government to pay a million dollars for nothing, it can hardly hope to secure water or mud and water at a less POS A ee ge There ought to be no doubt—there probably is none—that the Postmaster General will re- ject the offer to pay for the use of the backs of postage stamps for advertising purposes. On general principles it would be supposed that the Postmaster General had no power to accept such a proposal without new legislation, but, whether he has or not, the impropriety of this government's going into business as an adver- tising agent is too obvious to eall for com- ment. If such a thing were once permitted and a precedent established, where would the practice cease? This is, of courae, the most complete defense any man can make to a charge of crime, if he can put his case beyond question and the charge is merely one of direct participation. It is, also, the most difficult to sustain if thereis any crookedness about the testimony, and sometimes even where there is not. Indeed, it is often harder for a max actually innocent in deed and thought to make out an alibi than for a guilty man well couched by a shrewd criminal lawyer. A crime is com- mitted; for example, somewhere between sun- set and sunrise on a certain night. An in- nocent man is arrested on suspicion. If he were actually a thousand miles away from the scene of the crime during the night on which it occurred, he could doubtless bring proof of the fact, but if he were in the same town, how many honest witnesses could he bring to prove his whereabouts at every hour or half-hour of the night? They could swear where they be- lieved he was—in their company during the evening, and afterward in his bed and asleep. But how many would be willing to risk perjury | by swearing that they knew that he had not left his bed while everybody else was asleep. and stolen out, done the bad deed or assisted at it, and crept back to his bed again? This fa- miliar illustration shows how uncertain an alibi must be at best, under fire from a shrewd cross-examiner; and why it is rarely resorted to, except in the clearest cases. unless the prosecution has made so stre ¢ a presentation that the defense must resort to desperate ex- tremities. ——_ Capt. This is proposed in addition to the use of sweepers at night. Our present methods of street cleaning are clearly inadequate. The streets are not clean but dirty. The attentiom of the authorities is wisely directed towards the improvement of these methods and towards the discovery of a strect-cleaning system which will cloan the streets, — ‘The determination of the Commissioners to exercise their discretion in regard to the grant- ing of liquor licenses in such manner as to weed out the most objectionable of the saloons with which some sections of the city are too abun- dantly supplied will receive public indorse- ment. Neither in Washington nor in any other large American city today will a prohibition law be enforced, and that is consequently not the best practical law for such communities, But itis possible under tho existing law and through the action of the Commissioners to regulate more carefully the places in which and the persons by whom saloons may be kept. It is also possible to enforce the law more vigor- ously, and by amendment to render the regula~ tion which it provides more stringent.
