It this be the case, there will happily be no occasion or temptation to resort to the strained inter- pretation of the law which some enthusiastic civil service reformers and the shrewd spoils- men alike advocate. The former wish to give the widest possible scope to a good law, the latter wish to stretch it until it breaks. The law wisely protects the government clerks against the solicitation from them of political contributions by co-employes in any place, and by other persons in the buildings where the cle ks are employed. The govern- ment does not intend that compulsory tribute shall be extorted from the clerks by a request of money for political purposes from a supe- rior in office, whose suggestion is equivalent to a demand, enforceable by removal of the dis- obedient, Itdoes not intend that official duty shall be associated with political contribu- tions by s conversion of the departments into the unrestricted hunting grounds of the campaign solicitor. It lays down certain regulations concerning the conduct of its employes in their relation to one another, and it restricts also the right to enter for certain purposes upon goverument real estate. But, as the Supreme Court of the United States has stated, it does not make the general giving or receiving of political contributions illegal, And the invitation to contribute is also in itself an innocent act. The section of the law in reference to solici- tation of assessments by and from officeholders receives perhaps the most vigorous straining, but nstretching of the section concerning solici- tation in government buildings is also threatened in construing the tailing of a circular, giving in- formation where contributions may be received, to the department address of a clerk ,as a solici- tation in the building and asa misdemeanor.’ The Supreme Court, in the Curtis case, de- fended the section concerning solicitations by and from officeholders against the } charge of unconstitutionality by showing | that it is merely a government regulation j of government employes, following numerous | precedents. The corresponding defence of the | section concerning outside solicitors would | consist in viewing the section as being merely aregulation of conduct in specified places under government control. Actual presence in the specified places would seem to be es- sential to the offense. We should be slow to imprison a man merely for mailing a letter, the letter itself being innocent, the act proposed by the letter being legul, the mailing itself being unobjectionable if the number of a house instead of a government department were writ- tenon the envelope, and the misdemeanor turning upon the manner in which, through carelessness or the necessities of the particular case, the letter is addressed. Cases clearly involving a violation of the spirit and letter of the statute should be promptly and vigorously prosecuted and pun- ished. The clerks need to be protected both against the extortion of compulsory political assessments, and against any indirect infringe- ment of their conceded right as American citi- wens to contribute if they please. If this double protection continues to be extended the spoilsmen, who wish aconstruction to be placed upon the law which will make it offensive to tue American idea of personal liberty and per- haps cause it to be pronounced unconstitu- tional, will be disappointed. > + One of the democratic speakers at Richmond ‘Thursday night is quoted as alluding to Archi- bald Cary’s threat to stab Patrick Henry to the heart if he became dictator, and adding: “In the event that Mahone becomes the governor of Virginia some modern Archibald Cary will em- ulate his revolutionary predecessor's example.” Perhaps no one who heard these words re- garded them as anything worse than the rant- ing of an orator who had let nis tongue run away with his judgment. At the same time, they deserve the strougest condemnation. Men and parties are often judged, not so much by what they actually do, as by what they prate about. Asa party may be worsted at the polls because its platform contains threats and prom- ises which no rational being expects it to carry out if successful, so a man may ruin his own chances for preferment and cause the wreck of his associates’ fortunes by a show of violence which is never backed up, or intended to be backed up, by deeds, Moreover, we have seen cases in the history of our republic where weak minds have been wrought into a homicidal frenzy by such mouthings as these. Guiteau furnishes an example in point. He who puts into the head of some ignorant, unbalanced person among his hearers the idea of murder ing Miuone takes a fearful responsibility on himself, and ought to be made to feelit. In this country we have no use for the political assassin or for the instigator of political assas- sination. eer Mr. Ranney of Massachusetts in a recent speech advised the great republican fighting- cock to put its fout upon the little democratic sparrow and crush it.
