The legal positions assumed by the electric light company and the Commissioners in their pleadings are substantially those already outlined in this column. ‘The points of greatest interest in the contro- versy are of course those which relate to the power of the Commissioners to authorize a tearing up of the streets, and to the compara- tive merits of the two methods of lighting. The position of the Commissioners and the electric light company in respect to the streets is that the prohibition against opening them which the gas company discovers in the legislation of last session applies only to persons and corporations who seek to acquire easements in them for private purposes, and not tothe municipality itself in carrying out an authorized change in the method ef public lighting. Instances are cited in which the District has exercised powers similar to that claimed in the present case under alike indirect authority. In regard to the fitness of the incandescent light as a substi- tate for gas the pleadings say that it is of 25 candle power, that it is successfully used in Pittsburg, Staten Island, Plainfield, N.J., Port- land, Oregon, Denver and many other places, and that the candle power of the gas furnished is less than 20 as shown by the report of the gas inspector. The jeast that the public may expect to gain from the fight is an improvement in the publig lighting to the extent of an increase in the can- dle power of the gas from the figures reported by the inspector to the 23 candle power claimed by the gas company in its pleadings, —$<—<— The tidsl wave which swept along the New Jersey and Long Island coasts yesterday played havoc with property of all kinds that came within its reach and caused the death of one person, while a number of others narrowly escaped.
