Prohibition by constitutional amendment is overwhelmingly defeated in Massachusetts. Pennsylvania, which is soon to vote upon the question, is likely to decide in the same way. The secret of the series of defeats which prohibi- tion by constitutional amendment has recently suffered is found in the opposition of temper- ance people, who think that the adoption of prohibition as part of the organic act would be followed by the negleg$ and practical nullifica- tion of the law in cit and other localities where public sentiment is os yet op- posed to it, and that all practical means of regulating the liquor traffic in such places would be sacrificed without com- pensating advantages. They adopt the Greek lawgiver’s principle, that the best laws are not the best absolutely or abstractly, but the best that the people can endure. the best that will be enforced. The discussion of the liquor question in Massachusetts has been thorough and instructive, and. asin other states where prohibitory constitutional amendments have been defeated, information concerning the evils of the liquor traffic and the necessity for its strict regulation has been spread broadcast, and the result, it may be hoped, will be the adoption of such practical restrictive measures as local public sentiment will enforce. Every such defeat is, of course. to a certain extent a vietory for the liquor men, who have used the ultra-prohibitionists to defeat high license and the high-license temperance men to defeatcon- stitutional prohibition. But from the indica- tions of various phases of the controversy over the liquor question public opinion seems to be hardening into the definite conviction that for the large cities of the country high license is the most effective temperance measure; but that prohibition is the best in such counties or other limited districts as under a local-option system decide in favor of prohibition, for in them the prohibitory law sustained by local sentiment will be enforced. The happy effects of the local-option system are illustrated in neighboring counties of Maryland which have yoted for prohibition under this system, and which see to it that the law of their own delib- erate choice is obeyed. It turns out that Commissioner Wheatley’s secret examination of selected witnesses in re- spect to the management of the Washington asylum was not the mere preliminary to an open, formal inquiry, but a full-fledged investi- gation, on the strength of which the intendant is found “not guilty” and admonished not to do so any more. Of course the public is not satisfied with such an inquiry which avoids the witnesses who know the most about the charges, which sub- jects to a hostile cross-examipation only those who testify unfavorably to the intendant or matron, and which is avowedly based upon the evidence of persons in the employment of the persons accused, and excludes the evidence of all who are alleged to have been ill-treated. ‘The poverty which sends one to the poor- house is 2 novel ground upon which to pro- nounce a witness mcompetent and unworthy of belief. The intendant himself has reason to be dissatisfied with a decision which dismisses ebarges against him, but tells him hereafter to get better meat and to obey the law in re- spect to the disposal of property. There isa suggestion in this injunction that some of the charges are not to be dismissed. Both the in- tendant and the public must look fora really satisfactory investigation to the new Commis- sioners to be appointed. who will probably not be embarrassed in an open and thorough pro- secution of the inquiry. on The President added no small increase to his personal popularity in Washington yesterday when he ordered out the Marine band to enter- tain the congregation of juvenile egg-rollers gathered on the White House lawn.
