THE EVENING STAR has tne fullest Local Cireulation of any Newspaper in.the World. and as an Advertising Mediam is worth mere than all the other papers published im Washington. A protest by the District against Presideyt Cleveland's appointment of an outsider as the successor to Judge Merrick on the District bench would be unavailing if it should be based only on the ground that such an appointment is a violation of democratic home-rule pledges, and an unnatural approval and endorsement by the democracy of carpet bag government. Experience has shown that such a protest is fruitless. But in the present case the Senate, acting in accordance with an avowed political policy, is likely to act also in the interests of the District, and to rebuke by inaction the effort of the retiring President to dispose of a Judicial life-office as a political reward in con- tempt of the sentiment of the people whose laws this officer is toconstrue. The community finds, therefore, in this condition of affairs an excellent opportunity to express itself freely con- cerning such appointments, without deprecia- tion of the general ability or integrity of the ap- pointee in the present case and with a bearing upon the action of future presidents as well as of the present incumbent. The public senti- ment is that the appointment of an outside Politician to judicial office in the District is nothing less than an outrage.—an insulting im- putation of unfitness concerning the District bar and a lasting injury to the community. Practice in the District is essential to a model District judge. There is nothing in common between modern code procedure and the Dis- trict common-law practice modified by rules of court, and the more that a lawyer is imbued with the spirit of one the more unfitted he is to or direct practice under the other. A knowledge of the substantive law of the District, with all its omissions and imperfections and varied sources of derivation, sufficient to enable one to preside satisfactorily as a judge. can be obtained only protracted study. It is not to the interest of the District to have its Supreme Court supplied with ap- prentice members, who will be required to learn and and administer District law simul- taneously. Andthese apprentices from the states will generally be used-up and discarded politicians, too old and fixed to learn, even if they retain the ability to do The District bar boasts many men of ability and integrity. Professional jealousies may prevent the unani- mous selection of one among their num- ber for elevation to the bench. and reasonable fears of the petty revenge which may be visited upon them by a life-long judge whose confirmation they may fail to prevent, often restrains them from active opposition to the confirmation of an outside appointment, which they, neverthless. condemn as a men- ace to the community, and resent as an insult to themselves. In this case. however, the bar cap safely be outspoken. The Senate will hardly make an exception and confirm Mr. Stevenson, and what the lawyers of the city say will have special reference to the action of Gen. Harrison. But whatever the opinion of the resident lawyers so contemptu- ously set aside in an outside appoint- ment, the people of the District enter their solemn protest against a policy which will inevitably fill their supreme court with semi-legal, out-of-job politicians, rusty not merely im District law. but in law in gen- eral, appointed asa reward for political serv- ices, and not as a recognition of iegal reputa- tion, who will draw their salaries as pensions, muddle the law, damage the community, and subject the District's court to the contempt of the other legal tribunals of the republic, as long as they live. The elevation of the agricultural bureau to the dignity of » department with a seat for ite executive head in the President's cabinet is of ignificance. But asa vehicle for business that overloads other departments the new executive branch will grow in importance. The Interior depart- ment has far outgrown proportions compatible with its greatest usefulness, and the general land office could very properly be transferred to the agricultural department. So too with the signal office which can be of greater advantage to farmers than any other class. There is also a range of service in the State department that properly falls within the scope of the new department, and that is the system of collecting information about foreign agricultural methods and operations. This is mingled, of course, with statistical information about many other things, but to the farmer it isof the greatest value as determining the prospect of his market. This country could well afford to station a special agricultural agent at every important foreign mission. The interstate-commerce commission, which is classified as accessory to the Interior department, should be related to the Agricult- ural department if to any. The Secretary of a Col. Lamont’s future has escaped the hedge of his teeth. He makes the very brief admis- sion that he is to be president of a New York street-car company. He will no longer stand at the helm of the republic, but at the brake of @ big business concern. He will be busied with counting car tickets, instead of making out nominations and commissions. Instead of getting his fun out of clamoring office-seekers, he will be amused hereafter by striking con- duetors and drivers.
