4. THE EVENING STAR: WASHINGTON, D.C., FRIDAY, FEBRUARY 8, 1889. THE EVENING STAR. WASHINGTON: You probably never saw that expression be- fore; byt it has a proper meaning. It means live, energetic, enterprising, family newspaper, of wide circulation, like Tux Evewrne Star. And that Taz Star fills the idea is shown by the following extract from a letter lately re- ceived from the proprietor of a large business house in the city, who some time ago con- cluded to test the value of Tux Star's claims asa superior advertising medium, and, as will be seen, is abundantly satisfied with the result. Other business men will do well to profit by his experience. The letter is as follows: “ Beening Star: Enclosed find check in payment of my bill to Gate. Of course, as we have paid for the space occupied in THE Star, it would appear no further obligation rests upon us; and financially speaking ‘this is true; but we feel further indebted to you Decause our sales have just doubled since we com- Menced advertising; and in our opinion there is Bo other way for a man to increase his business except through the columns of somo paper like ‘TRE Stax, which every one reads £0 eagerly. “We one time sent an advertisement for a boy to you, without mentioning the location we wanted % put in, and the same day it appeared in what ‘Wo considered an obscure portion of the paper. We counted every applicant that came and found the number 876 in twodays. This proves every inch of the paper is read by the mass of the peo- 6.” peyine our grateful thanks for the good you have done us, and excuse the liberty we take in ‘writing you this note.” ‘The legal principle applicable in such pur- chases by the District's intermediary as that of the ninth precinct station site is to the follow- ing effect: If a person assisting me and in my confidence obtains information from me in re- spect to the property concerning which he is acting, which information he would not have obtained except by virtue of his relation to me, and of which he makes use and acquires title, then merely by virtue of the fiduciary relation my assistant is estopped from acquiring an interest adverse to me, and, obtaining title, he will be viewed as a constructive trustee and I will be the real purchaser. Such an agency, though it relate to real estate, may be created and proved by parol. It makes no difference that my agent has received no valuable con- sideration for entering upon the re- lation. In the case of Switzer vs. Skiles, 3 Gilman (Ill) 534, it is said: “The confidence reposed in him, the actual entering on the auties of the trust, and the injury which may result to the beneficiary if he do not faith- fully perform it, are regarded as a good and sufficient consideration.” No loss of any kind to me needs to be shown. The trust arises from the fiduciary relation. If there is loss to me in such a case, resulting from a fraud, a Rew ground for holding my assistant is fur- nished, and no special contidence in him on my part is essential. Ly the testimony. it ap- pears that the Commissioners placed unlimited confidence in their assistant in the real estate purchases. His opinion was weighty in the selection of sites, and his views in respect to the reasonableness of prices were highly re- garded. Offers by other agents of property were turned over to him. So thoroughly was he trusted that in negotiations for purchase, if the price asked was not excessive on its face, and it seems never to have been so regarded, the Commissioners would never go beyond him to ascertain whether the property could not be obtained more cheaply from the vendor directly. He was on such a footing with the Commissioners that he never “got left” in any of his negotiations through their fault, and he could reasonably count on their friendly preference. Through these confiden- tial relations he could ascertain with precision what site would be bought,—indeed his opinion was a factor in deciding this point. In cases where, without the knowledge of the District, he bought for himself the site indicated, and concealing the fact that he was the real vendor, and utilizing the confidence of the Commis- sioners in his opinion concerning prices, and their friendly preference of him as a negotia- tor, he sold again at an advance to the District, he would seem to place himself within the range of the legal principle cited. If any loss to the District needed to be shown it would be found in the fact that the purchase by the assistant took the property out ef the hands of one who did not know that the District specially desired it for a special purpose and placed it in the possession ef one who had this knowledge, with the re- sult of increasing the price. The showing made against the intermediary even by the im- perfect examination of the investigating com- mittee is as strong as that established in the line of cases represented by Gower vs. An- drew, 59 Cal., 119; Webster vs. King, 33 Cal., 48; Hardenbergh vs. Bacon, 33 Cal.. 356, and many others cited in 2 Pomeroy’s Equity Juris- prudence 437 n. 3, 628 n. 1, and 631 n. 1. $$ Whether the successor to Judge Merrick is appointed by President Cleveland now or by President Harrison hereafter « District lawyer shonld be selected. Other things being equal, the lawyer who is best acquainted with District law is best fitted for the position. An outsider who has practised in a code state will need a special education in District law and procedure, Washington, with its numerous important courts and the vast interests concerning which litigation is had here, can boast as able an array of lawyers as any other city of the United States. It is claimed that the best or rather the most prosperous local lawyers cannot afford to sacrifice their more profitable law business for positions on the District bench. But there is mo reason to believe that an abler judge, at the Jow salary paid, can be obtained from outside the District than from within it. pipettes The objections of the House District com- mittee to some of the Senate amendments to the District appropriation bill are doubtless in- tended to throw the proposed changes into conference with the purpose only of modifying their form. In other cases there will be real issues between the two bodies which must be settled by compromise in conference. In this clash of opinions may the fittest survive, and decisions most satisfactory to the people of the District be evolved! —-——____ Washington will feel relieved to know that ber money spent in the rotten tunnel is not to be wasted by the abandonment of the tunnel and the construction of a surface aqueduct, but that the contractors are to be compelled, at their own expense, to make their work good. The capital petitions for the speediest increase of her water supply at the least additional expense. oo It was only rumored that Bismarck would Fequire the too-presumptuous and over-pro- gressive German representative at Samoa to resign. Asa matter of fact, it is the American Tepresentative whose resignation is compelled. The new Sunday Herald, under the manage- ment of Soule and Hensey, promises to be a bright and reliable paper, creditable to Wash- | ington journalism.
