COYLE ARGUES THAT ALL PROJECTIONS OVER THE BUILDING LINE ARE ILLEGAL. Judge Merrick took up yesterday the suit of the United States against Mrs. Annic Cole and the Commissioners to prevent her from build- ing a bay-windowin the reservation at Thomas Circle. The defense in the case claimed that the bay- window was sanctioned by ee eons approved July 7, 1794, by President George ‘ashington, permitting owners to occupy for certain purposes 7 feet of the adjacent street. The lary ogy ee involved in the case, y Mr. Coyle for the United States, is whether or not the Commissioners can give to private individuals the right to use any part of the public streets. Mr. Coyle contended that the fee of the highways is in the United States, and that the erection of bay windows are encroachments in the right of the national government, — Merrick asked Mr. Coyle if he main- tained that all the thousands of owners of bay- windows are liable to action for ejectment to be brought by the United States. ir. be ow ded that he took this ground, stating, however, that it would be an impossi- bility to bring suit all rsons.
