WASHINGTON: that of any other daily paper published d= Washington, and much greater than that of all the other daily papers here added together. The foes of the Bell telephone company will find in the decision of the Supreme Court, over- ruling the company’s demurrer as to the gov- ernment’s right to figure as plaintiff in a suit for the cancellation of a patent, some consola- tion for the defeat of last September in the Massachusetts circuit court. There does not seem to be any good reason, as Justice Miller says, why, if the power to enter a suit for cancellation resides in any individual, it does not reside equally in a government which nts an aggregation of 60,000,000 individuals, Undoubtedly the telephone party will recall with satisfaction the refusal of the Supreme Court, last March, to accept the evi- dence then offered by the five competing in- terests, of the priority of other claims to Bell's. ‘This was done, however, only by a vote of four justices to three, the minority consisting of Messrs. Field, Bradley and Harlan. Justice Lamar had come upon the bench too late to hear the argument, and Justice Gray abstained from participation in the decision through motives of propriety. The complexion of the court has changed since then. There is a new Chief Justice, whose views on the subject arenot known; and Justice Lamar, who would probably have voted before, on general principles, with the minority, and tied the court, will have no reason to keep silent hereafter. When the government case, there- fore, comes to Washington at a later stage, it is by no means safe to assume that the matter will be treated as it was before. The govern- ment counsel, moreover, assert that they have worked up their case with great care, and that they have a quantity of new and incontrovert- ible evidence, which was not brought out by the private suitors, partly because some of it had not then been discovered, and partly be- cause they did not care to expose their full hands to each other in the then uncertain con- dition of things. The effect of the latest development upon the telephone company may not amount to much for the present. at least. After all these years of fighting, the foes of the corporation have only now got to the point where, ina case instituted by the government, a court of origi- nal jurisdiction is to inquire into the charge of fraud on its merits. The inquiry itself has yet to be made, which, in view of the proverb- ial slowness of the federal tribunals, loaded up with work as they are, may consume a long time. Then the Supreme Court must enter- tain an appeal from whichever side is beaten in the first fight, and this will eat up more time. Possibly a technical ruling of the lower court on some essential matter may be set aside and a new trial ordered; and 80, by shrewd management, the company may be able to keep its case in the courts and stave off a final settlement of the main question until its fandamental broad-claim patent shall have run its course and become valueless. Even the government of the United States, with all its boasted wealth and power, has its hands full when it attempts to drive out of existence a monopoly backed by as many millions of dol- Jars as stand at this hour behind the Bell tele- phone interest. gan S Sees This is the first year in many when the news- paper correspondence sent out of Washington during the month of November has not bristled all over with prophecies about the forthcoming President's message. Doubtless the lack of interest in the subject just now would be ex- plained by the fact that the President who will write this message is going out of office soon, and that the country will not be prepared to give the same weight to his utterances as here- tofore. But it should be remembered that these last words are sometimes among the most interesting spoken by a public officer in high station. The last message of President Grant had a pathetic quality quite foreign to what he had written before, and was often quoted by the friends who wished to see him nominated fora third term. It is unlikely that President Cleveland will give us anything pa- thetic; but it would not be strange if he put forth another message as remarkable in its way as that of last December. He is a man whose ideas, once formed, die hard. It is scarcely probable that, like Mr. Thurman, he considers the late election a knock-down blow given by the people to the theory that the tariff is a tax. On the contrary, there is the best reason to suppose that he believes the tariff war to have only begun and the future to have in its keeping some glorious victories for the friends of revenue reform. It may even be that there lurks in his mind a faint foreboding of a democratic uprising in 1892 in favor, not only of the party issue of 1888, but of the party standard bearer also. The message which: goes to Congress three weeks hence should not be dismissed as uninteresting before it is read. —E Political excitement, which for the last week has been diffused over the whole republic, is now largely concentrated in West Virginia, where each side still claims the electoral vote, the governorship, three out of four congress- men, and one majority in the legislature which elects a United States Senator. The solidity of the “solid south” and perhaps the control of the next House of Representatives depend upon the showing of the final count, and the eyes of the world, at any rate of the new world, are on doubtful West Virginia, ——-—-—-—— As the appropriation to remove the city post- office to the pension office building is conceded to be insufficient, and as additional funds must be secured at the approaching session of Congress to complete the transfer and establish the post-office comfortably in its proposed new quarters, the wisdom of delaying preparations for the removal, at least until Congress meets, would seem to suggest itself, The hall of the pension office building is very much needed for the inauguration ball. If Congress, when it meets next month, will modify the ante-clection policy of pinching and penny-wise economy, and agree to give Wash- ington a new post-office site and building, two desirable ends will be gained. The pension office will furnish an admirable hall for the inauguration ball, and the local post-office will not be compelled either to occupy tumble- down and unsuitable rented quarters, or to re- move to the inconvenient location proposed for, it im the pension-office building.
