Railroad to permit the United States to build the Eastern Branch Dridge, has passed the House, with a proviso that one-half of the sum appropriated shall be paid out of the District rev- ‘enues, and the Senate has assented to the amend- ment. Washington wants this Dridge, and delay tm the present stage of Its construction will in- volve greater expense, probably, than to con- ‘tribute with the United States to a purse, @ slight testimonial of regard, to conciliate ‘the raliroad. The United States and the taxpay- ers and property-owners of the District are ac- eustomed to supply freely every need of this cor- poration, but even their enforced and habitual Subserviency to the rallroad must experience a Straining sensation In this matter. Mr. Hemphill, speaking for the House District committee in ex- planation of the bill, said: “The Baltimore and Potomac Railroad Company, by reason of the ex- tension of the track, which they are entitled to under the law, bave a title to the land upon ‘which this bridge, as now planned, will land; so that the public in crossing the bridge ‘will rum against the railroad. It 1s necessary to extend the bridge far enough over toallow the yaflroad to run under it. The Baltimore and Po- tomac Raflroad Company have the right of way, J think, 60 feet on each side of its truck, and, asthe bridge is now planned, people in crossing it will Fun right into the railroad track. This bill pro- poses to give additional money to build a better ‘bridge, so that people in crossing the bridge may goover the railroad track instead of running rignt into it.” The United States alleged in the action ‘which ft brought to restrain the railroad from in- terfering with the work of Government agents ©n Government property that the road had de- parted entirely from its chartered route in the city, and had no right whatever in the vicinity of ‘the bridge, and the testimony of the Government oMpers is to the effect that the original plan of the bridge provides ample space under the struc- ture for present tracks. The court has not yet passed upon the questions which Mr. Hemphill de- ‘cides in favor of the railroad. As Congress has al- ‘ways accepted the rafiroad’s presentation of law and facts with far greater avidity and enthusiasm ‘than courts and juries have, it 1s Just possible that ‘the railroad may be found by the court not to have title to any of the Government property, eltyer 129 feet, as Mr. Hemphill thinks, or even 60 feet. If the mere right of transit gives titls the railroad has tle, according to Mr. Hemphill’s view of the ex- tent of the right of way strip, to private houses along the streets of Washington within 60 feet of Its tracks, and the Farwell bill gives it title to all ‘the streets and reservations south of Maryland and Virginia avenues.
