One of the most interesting features of this ses- sion of Congress is the political maneuvering in Telation to the territories seeking aduission to the Union, The Senate is now considering the repud- ican proposal for the admission of the southern half of Dakota, which is supported by a strong ar- ray of facts and arguments The democrats, who have made their policy a subject of caucus-rule, meet this with the demand for the admis- sion of Dakota as a whole, in connection ‘with Montana, Washington and New Mexico. ‘The partisan character which has been given to the controversy threatens to leave it as far from settiement at the end of the session as it was atthe begiuning. It ts certain, at any rate, that no new staves will be voted into being before the Presidential election. Besides this political ma- ‘euvering, other interesting discussions are going on, ‘The complaint is made in Idaho that the Stewart bill, permitting the citizens of North- em Idaho to vote whether they shall send delegates to the constitutional convention of the proposed state of Washington ignores the Fight of the whole territory to vote cn the ques- ‘ton of dismemberment, and it is charged that all ‘this is only preliminary to the execution of another design of Senator Stewart's to annex Southern Idaho to Nevada. Then, too, many pro- ‘Yeas to see in the plan for admitting New Mexico a deep scheme of the Mormons to capture a state, ‘and thus carry thetr “peculiar institution” of poly- ‘gamy from under the control of Congress. They are said to have obtained already a strong grip on the politics of New Mexico by the quiet migra. ‘Won of saints into that territory from Utab. But Mr. Oates, with his knowledge of law, is ‘aware that the House of Representatives is not @ judicial body, and has no authority to decide ‘whas is constitutional and what is not constitu- ‘Vonal im legislation. Its business is to enact laws for the government of the republic and vote sup- lies from the Treasury to enable these laws to be executed. If a lawis believed to be unconstitu- ‘tonal, it 1s the business of the courts to pass upon ‘the question. While, therefore, it is Mr. Oates’ Privilege, whenever he believes it to be his duty, to Utter aloud protest from his place in the House, ‘and prevent, by argument, If possible, the passage ‘of any measure which seems to violate the organic law, he hay no moral right to tie up Just and unjust legisiation allke, to throtie the business of tne whole people, for the mere sake of making his protest more emphatic. ‘Let him put himself distinctly on record, and then Telease the machinery todo its regular work.
