Yesterday aiternoon, about 3:30 o'clock, a des- erate affray occurred on the corner of 1st and O streets northwest, in which Philip Hirshman, a white man employed by the Fowler Spring Mat- tress Co., Was terribly beaten. Hirshman had been Sent with & mattress to deliver to Julius Adams, a colored man, and to receive a part or the whole of the payment for it It 1s said ‘Wat Adams refused to pay, and whem Hirsh. JUDGE COX WEARS ARGUMENT AND MODIFIES THE ‘RESTRAINING ORDER. ‘The case of Gutwillig Brothers, of New York, against Earnest D. Mayer and Jacob Rohr, of the Bon Marche, and Isadore Saks, the assignee, came up before Judge Cox in the Equity Court yesterday afternoon, ahd was argued by Mr. L. Tobriner for the complainant, and by Mr. Edwards, of Edwards & Barnard, for the defendants. Mr. Tobriner claimed that the assigninent was irregular, and & Tecelver should be. appointed to insure {ts proper execution and an Injunction issued to restrain Mr. Saks from paying the preferences. Mr. Edwards contended that the case was not one forthe Equity Court. Judge Cox said that he saw no reasou Why Mr. Saks should not be allowed to proceed, and that there was no evidence of his having done any Wrong. ‘The court then decreed that the restrain- ing order be continued unt the final hearing as to the preferred creditors, Jacob Rose and Jacob Meyer; and the defendant, Isadore Saks, as assignee, will not pay the same until the further order of ‘tue court.
