Selling juor to Minors. ‘REMARKS OF JUDGE SNELL IN IMPOSING TWO FINES ‘ON A GROCER TO-DAY. James McCarthy, who keeps a grocery store and ‘Dar-room corner of Ist and N streets southwest, Frank P. Closs appeared for the defendant. Joseph Mansfeld, ten years old, testified that on ‘the 26th of last month he went into the defend- aav’s chased & half-pint of whisky, for which he 10 cents. The defendant, he said, waited on him, and with other boys he went down to the Drick-yards and got drunk. Richard Williams, 12 years old, testified that on ‘the same day he paid two visits to the defendant's each time purchased half a pint of ‘whisky. The first time he went there he told the defendant that bis mother had sent him, but the ‘he told him nothing. Witness said he her Witnesses gave corroborative testimony, the defendant denied the charge and said that, the Willlams boy ts concerned, witness asked him why he came for the liquor, and he said ‘Als mother wanted to put it in cake. ‘The judge said: “If a minor presents himself in Sman’s place and wants whisky the law throws upon the dealer to know what he is doing. Kelly, @ man with @ patch over one eye. Mr. Kelly had a great comforter wound about his ‘throat bet in delicate health, asked to be ited to ait wh. A chair was given him and said his acquaintance with Daley about fifteen years ago and continued until seven or eight years ago, when Daley left the place. Daley’ worked tn a ‘calico print mill there. Mr. Kelley pictured Daley as a sort of butt of the com- munity there. He was considered, he said, “as a man Who was not altogether there.” Being asked to explain this phrase, the witness said he meant “a man who was not altogether in his mind.” He sald that the boys and others on the street used to huiloo at him “How about the women?” and other things, and Daley would only grin and sinile. Sometimes he would answer the question. ‘The witness did not think he Was insane, but believed he had not real good sense and had "not a sound mind. When asked by the district attorney why he thought Daley was not of sound mind, Mr. Kelley said he did not think a man of sense would allow people to “holler” at on the street and take it as he did. Witness met Daley here at the last inauguration, but Daley did not know him. Daley earned about $9 a Week; he was reputed to be a man of habits and Saving, and he went often to the Catholic burch. A FEMALE WITNESS. ‘The next witness also came from the Falls of Schuyliill, It was Mrs. Margaret Hanlon, with whom Daley boarded for eleven years. She sald sometimes she thought he was of unsound mind. He used to be cross at times. Once one of the Servant girls went to the city and bought a bon- net, When she returned Daley said ne did not Uke the bonnet, aud he threw it into the parlor fire and bui it, Afterward he paid for the bonnet. He got very religious and used to talk Teligion to witness. He went from her house in 1 @ Catholic college or institution at Ger- mantown, and stayea there a while. He went there to become a brother. When he came back he said they were all rascals and trying to get bis money, and that he did not believe in any re- ligion.” He returned to her house from Washing- ton some years His actions were strange. He wouid sit for a long time without talking. One morning he weat out without saying anything and she never saw him again. “Did you notice,” asked Mr. Miller, “any delusion of his in regard to the ladies?” “He thought,” said Mrs. Hanlon, “that every lady that spoke to him was in love with him.” On cross-ex: tion Mrs. Hanlon said she could not say Daley Was insane, but he did a great many crazy acts. One day he went to his room and threw his trunx out the window, breaking the glass, “She never knew him to threaten any one’s life. Jeremiah Hanlon, Mrs. Hanion’s husband, loco- motive engineer, living at the Falls of Schuylkill, was next called,’ He did not think Daley was alto- gether of a sound mind. He used to come home nights talking and lat to himself, and go to every room in the house hallooing and’ screaming. When any one asked him what was the matter “they couldn't get no sense out of him.” On cross- examination the witness said that one time some one sald there was @ fire, and Daley rushed up- stairs and began throwing things out of the win- eplsatets uy mi oe Sota eng for twi thumbs and began to sintie. isd ANOTHER WITNESS AS TO DALEY'S DELUSIONS. ‘Patrick Ryan, of Philadelphia, formerly of the Falls of Schuylkill, the next witness, thought Daley was crazy. “Sometimes,” he said, “he has cme oon peel nome but more times he asn't.” “Do you know of any fancies or delusions he had?” asked Mr. Miller. “I never knew him to do anything bad,” said the witness, who evidently had but a vague notion of “Did you know of any fancy or delusion he had — henge igiles ds pea “I never knew him anything,” the Witness, “but I have heard of it.” om He saw Daley after he went to the brothers at Germantown, Daley sald he did not think he could become a brother, and waen witness asked him why, Daley said because they were tempted very much.
