f. i Ge@ssIP ABOUT THE B. AND 0. Viee-Presidemt Spencer Gives His Views on the Situation. |. PIERREPONT MORGAN SAYS MR. GARRETT HAS XOT SOLD HIS STOCK—THE TELEGRAPH NOT YET GONE TO GOULD, BUT PROBABLY WILL. , ‘The gosstp tn regard to the coming change in she Baltimore and Ohio presidency and the new policy to be pursued inthe management of the Toad continues active in New York, Philadelphia, and Baltimore, A Baltimore paper says that the Mnance committee and the board of directors of {ne Baltimore and Ohio company wil! at the Octo- ber meeting have up the matter of the haif-yearly dividend. It is definitely said that this has not Deen discussed, and one of the prominent stock- holders in the board says he does not believe the idea of passing the dividend ts entertained, but that one will be made as usual. An inside letter Fecetved in Baltimore from New York gives some Ponts of interest concerning the negotiations with the syndicate. It says: “Mr. Blank 1s here, and has had a talk with Morgan on the Baltimore and Obio. He says the syndicate take the $5,000,000 referred stock, and the parties with whom they Will, guarantee that tbis shall control the road. This, together with the $5,000,000 bonds, 1s 6d abroad, so that the ten miliions will come jn money trom the other side. The bonds are se ured by A LIEN ON THE WASHINGTON BRANCH, on terminals in several places, and on various other properties, including bridges over the Ohio River.” Mr. Garrett may, while abroad, make an extended trip in the East. He 1s reported to be Dooked by steamer for home on October 22. Mr. Spencer was interviewed ye York city in relation to the conilicting statements published the past two days in regard to the Status of the property and its actual Telations to the syndicate and the other trunk lines, He was asked: “What foundation fs there for the state ment that your road has passed into the control of the syndicate of which Mr. Plerrepont Morgan is the head, and how far will that control ex- tend?” ‘WHAT MR. SPENCER SAYS. Mr. Spencer, in reply, said: “The statement 1s absolutely without foundation. The syndicate does not want control. It simply desires that the same relations shall exist between the Baltimore fand Obio and the other trunk lines that now ob- tain D- tween, say, the Pennsylyania Kailroad and the Reading, ‘and the Erie, and the New York Cen- tral” Mr. Spencer said that this had been dt Unetly reaMrmed this morning 1n a conversation with Mr. Morgan. “Harmony and co-operation do not mean subserviency of any one interest. ‘The same syndicate practically funded the floating debt of the Erie Ratiway, aud no sub- serviency to New York Central power fol- lowed. ‘The same bankers backed the Reading Teorgantzation, but there has been no suc- cumbing to ‘Penusylvania Katlroad domina- Won. In fact both these compantes, which were in far Weaker positions than the Buitimore and Uhio, are stronger and much better able to pro- Yect their Interests, develop their resources and serve the communities along their Tespective lines by reason of their associ ation with the strong-monted powers of this country and England. The syndicate has the greatest interest now in the growth and progress of the Baltimore and Ohio, and to secure this growth and progress absoltite Independence of Other corporate predominance 1s essential, and the oad must be worked in the interest of the cities ‘and territories it reaches, “THIS CONDITION OF HARMONY 13 easily obtainable, and 1s as much in the interest of the Baltimore and Oulo as of any other line. There is no agreement or stip- ulation that the Readinz and New Jersey Central contracts with the Baltimore and Obio shail iu any way be interfered with; in fact, they €annot be without the consent of ali three corpo Fations, which are parties to them, as they are Jegal and binding upon all of them.’ There 1s no Truth in the statemen: that $4,000,000 of the Bal- Umore and Ohio obligations Were lifted on Sep- ‘ember 1. No such amount was due, and there Was no pressure upon the company at the time. ‘The loan secured through the syndicate was for future use, and the proceeds wili be used only as “It Was stated that you would succeed to the Presidency.” “J have nothing whatever to say upon that sub- it will be time enough to discuss that when r. Robert Garrets signifies his determination to retire.” MR MORGAN'S TALE ABOUT THE TELEGRAPH. A New York special telegraphed last night as follows: “Vice-President Spencer was in the city to-day and had along consultation with J. Plerre- | th. pont Morgan, at the latter's office. When asked if | were true that he had been selected as Mr. Gar- | TetU’s successor, Mr. Spencer replied that ali talk about Mr. Garrett resigning and about his taking Bis place was entirely preuiature. He added that Mr. Garrett had not sold his Baltimore and Ohio Stock, and that there Was no probability that he would. When asked what assurances there were ‘hat the preliminary contract with the syndicate ‘Would be carried out in the event of a change in the control of the road, Mr. Spencer replied that there ‘Was no probability of any such a coutingency, but a anyevent the contract was with the company Atself, and could not be abrogated if the conditions Were fulfiied. J. Pierrepont Morgan, when asked if Mr. Spencer had been selected by the syndi- ate as Mr. Garrett's successor, repiled that he id not know that Mr. Garrett had resigned, and he did not Know that the question of a successor had been considered by the syndicate. Mr. Spen- cer was a very good man, he sald, and he did not ‘Want to be understood as depreciating bis quali- feations for the position. President Ring, of the Erie, arrived in the city to-day, and declared that 4m no event should he leave the Erie to return to the Baltimore and Ohio. Edward Lauterbach, Who obtained much familtarity with the affairs of the Baltimore and Ohio, while acting as counsel for Henry S. Ives: has Deen employed by ‘the grn~ dicate to investigate into the condition of tue Baltimore and Onio as a preliminary to signing a Bual report. There were no important develop- ments to-day in regard to the deal, ‘THE TELEGRAPH HAS NOT YET GONE TO JAY GOULD. Dut ts regarded as sure to go to him at his own terms when be 1s ready to take it, which will probably be when he can get the Commercial Ca- Die and the Postal Telegraphs at the same time. Mr. Spencer's declaration that the Baltimore and ‘Ohio will be run as an independent trunk line not subservient tothe Pennsylvania 1s regarded as trge enough, Dut as not really explaining the act- ual situation, ‘The conditions imposed by the syn- Gicate make it clear that the Baltimore and Onto | iaust abandon all opposition to the Peuns¥ivania So far as New York ls concerned, cease its war of Fates and get tnto this city on terzus satisfactory to the Penhsyivania, and thesyndi-ate, which thus Seems so solicitous for the interests of the Penn- sylvania, makes it as another condition that the Management of the Baltimore and Obio shall be Made satisfactory to the syndicate.” Alleged Bribery in New Hampshire. ACHARGE MADE BY STATE SENATOR SAWYER TO BE INVESTIGATED. In the New Hampshire senate yesterday, Sena- ‘or Sawyer rose to a question of privilege, and made the following statement: “It becomes my duty to myself and to the senate to place before this body the facts of a transaction that took place im the State House last week. On Wednesday 1 was called from the senate chamber by the ser- weantatarms, and met Kirk D. Pierce. During Uhe conversation he proposed to me that I make @ speech for the Boston and Maine Kaliroad for 000. I need not say that the proposition was indignantly declined.” A committee was appointed to Investigate the charge of bribery, with power to send for persons and papers, The committee will Deyin its Invest gations to-day. Mr. Pierce, who ts alleged to have Hoade the attempt Yo bribe Senator Sawyer, is a wyer isboro’ Bridge, and a nephew of the late President Pierce. = Lieut. Darr’s Elopement. HAVING RESIGNED HE CANNOT BE REACHED BY THE ‘WAR DEPARTMENT. The confirmation of the story of the e@lopement of Lieut. Darr, who re- cently resigned his commission in the Amy, with the wife of Lieut. Totten, of West’ Point, coming so soon after the’ de- aials by the "relatives on both sides, has created & great stir in military circles. "The officials of the War De are Very reticent tn allud- to the matter, but the official report that he had been seen in’South America is not denied. Adjutant-General J. C. Kelton said: “Lieut. Darr resigned his commission some Ume ago, the resignation to take effect Septes er 1. ‘He 1s, therefore, no longer under the jurisdiclion of the Department and 1s not amenable to any authority but that of the civil courta.
