THE TERM OF SERVICE TOO LONG—ONE MONTH ‘ENOUGH. ‘The protest of the citizvns’ committee against the long term of three months for jurors in the District of Columbia ts entirely in line with the position taken om the question by the Department of Justice. That active business men should be taken from their business for so long a time 13 looked upon as a great injustice to the citizens, and causes those whose services would be most valuable to endeavor inevery way to avoid jury service. Attorney-General Brewster spoke of this in his last annual report, and recommended that the time of service be reduced to one month. ATTORNEY-GENERAL GARLAND renewed this recommendation in about the same terms In his first report. The report says: “Ser- vice as a jurorin the District. means an enforced attendance at court and almost total abandon- ment of private business for one-fourth of the whole year, a hardship and injustice that 1s not imposed upon citizens In any other place in the United States, and would not be tolerated In any community where the people havea voice in fram- ing their own laws. At Rockville the train Stopped, and the engin= was brought back to this law a person may be excused by the court from Serving On a Jury when, for any reason, his tnter- ests or those of the public wili be matertally in- jured by his attendance, or where his own health or the death or sickness of a member of his family juires his absence, Continuous absence and of business for three months in the yeur uld materially injure the interests of any busi- ness mau, and a respectable physician would readily certify that attendance for that length of Ume in a crowded court-room would be INJURIOUS TO THE HEALTH, ‘so that the court fs reluctantly compelled to ex- cuse from service the very men who, of all others, are best qualified to intelligently afd and assist in the administration of justice. Added to those who are thus excused there are always found among the Jurors several who, although their names were placed in the jury-box'and they have respondgd to ‘the summons, are iu public ewployment, and there- fore exempt. When the court has passed upon the varlous claims to be excused and exempted there will remain probal one-half of the num- ber of jurors required by law, and before proceed- ing with the trials of cases the attendance of the full number must be secured. The way in which the required number ts to be selected {s not cleur! dedned-by the law, which Is interpreted by eacl Judge according to bis own view. Some of the Judges cause the jury-box to be aguin opened and ‘Ube requisite nymber of names drawy Olt; others direct the marshal to summon talesmen; but both Ways have been beld to be proper. . “In selecting talesmen the marshal may sum- mon a wan or men from among the bystanders in the court, persons passing along the public streets, or from any of the stores, banks, ary apes ofieces, hotels, or residences im the city. In select- ing talesmen another great hardship ts Lmposed _— the person so summoned. When a name Is dfawn from the jury-box in the first instance the person whose naing is so drawn receives a reason- able notice that his services will be required, and is thus enabled to arrange his business that it may not suffer by his absence; but to suddenly and unceremoniously take a man from his resi- dence or off the street, a merchant from his store, | or acierk or bookkeeper from hts bank or count ing-house 1s an arbitrary act of injustice, which, although practiced at the beginning of the pres ent century, 1s totally inexcusable ut this ime; and it 13 very doubtful why ther a person so sum moned, if compelled to serve, has lis mind Sual- ciently free from care and anxtety about bis own Dusiness to tntelligentiy adjust, and, decide the differences existing In the affuirs of others. When the additional jurursappear In court their excuses are also heard, und, If any are excused, others are Summoned in'thelf place, and so on ‘upul, after the expiration of from one to three days, ‘ind in some instances even longer, the court has Secured Uwenty-three grand jurors and tweaty-six petit jurors who are either willing to serve or have failed to show a sufficent callse to be excused.” WHAT THE ATTOKNEY GENERAL SAID TO-DAY. It 13 probable that Attorney General Garland will as strongly urge this upon Congress in his next report and endeavor to have the Jury term shortened. He said to a Srax reporter to-day that he thought the term shouid Le shortened, and be still held the expressed in his report and that of his predecessor. —— ‘Transfers of Real Estate, J. A. Justice Bradley, in the Supreme Court of New Jersey, yesterday dissolved the injunction re- straining the Baltimore and Ohio Railroad from building a bridge over the Arthur Kill, and he also denied a motion to appeal trom this decision. He held that Congress had the right to confer the authority on the Baltimore and Ohio Co. to build the bridge, and that the words of the act were sufficient broad to give this authority. Aftet oe on this phase of the case at some length e justice “In our judgment, if Congress itself has the power to construct ‘a bridge across a navigable Stream for the furtherance of commerce. whoa States, it may authorize the same to be done by agents, whether individuals or corporations, ready exist and concerned in the enterprise. ‘The objection that Congress cannot confer power ‘on @ State corporation is untenable. The power to regulate commerce between the several States is given by the Constitution in the most general and absolute terms, ‘The power to regulate, as applied toa govern- ment, has a most extensive application. With to commerce it has been expressly held ‘that it tg not contined to commercial transactions, Dut extends to seamen, ships, navigation, and ths appliances and facilities of commerce, and it must extend to them or it cannot embrace the whole subject. Under this power the navigation of rivers and harbors had been opened and im- proved, and we have no doubt that canals and Waterways may be opened to connect navigable Days, harbors, apd rivers with each other or with the interfor of the country.” After giving some citations the justice adds: ««gtill, 1t fy contended that although Congress may. have power to construct roads and other means of communication between the States, yet this can only be done with the concurrence and consent of the States in which the structures are made. If this issothen the power of regulation in Con. Fess 18 not supreme; tt depends upon the will of @ States, We donot concur in this view. Commissioner Michael Wasserman left his place among the defendants and took the witness stand in bis own behalf. ‘Wasserman was very pale and his voice trembled. He denied seriatim all charges of bribery against him, and, in explaining how he came to receive certain sums of money, said: “In 1884 the County Democratic Club electéd ine_ag one of the com. mittee to go to Washington to bring the conven- tion here. I collected money everywhere. We went down to Washington and kept open house to show the people of Washington the hospitality of Chicago, ‘The result was that we brought the convention back here.” ‘The State did not take the trouble to cross-examine Mr. Wasserman, Oe The Kentucky Election, REPUBLICAN GAINS IN SOME COUNTIES.
