Morris), overruled the motion to dismiss as to Harvey. The court said that Congress assumed, when it passed the act, that the title was in the United States, and the purpose was that parties claiming title should maintain the claims by evidence. The lands were for the public use, and 1t was provided that if the court was satisfled that any defendant had title to the land they should ascertain the damages. The Government was engaged in a great improvement, and it was for the claimants to assert ttle, with tne view of the court ascer- taining and fixing the full value of such lands. ‘The motion was overruled and the cause remanded. emg A New Trial for Jacob P. Angney. ‘THE VERDICT SET ASIDE BECAUSE OF JUROR FISHER REING OVER AGE. Judge Montgomery to-day, In the Court in Gen- eral Term, delivered the opinion tn the case of Jacob P. Angney, convicted of assault and bat- tery with intent to kill John H. Wilmot, and as- saulton Thos. R. Turnbull, setting aside the ver- dictand awarding a new trial. ‘The defendant filed motion in arrest of Judgment and for a new trial on the ground that the indictments were not suflicient on which to find the verdict, in that 10 did not set forth a crime of higher grade than an assault, and that one of the jurors (David Fisher) was above the legal age. ‘The court held that the fndictments were suifictent, and on the second int stated that Fisher was empanelled April 5 jast, and stated that he was under sixty-five years of ake, but the proof shows that he was born March 17, 1820; but admitting that he was correct about thé year of his birth (1822), he must have known that he was atthe time over sixty-five years of age. ‘The judge read the qualifications of jurors (section 872) and discussed very thoroughly the decisions on the point whether tt was not too late to object after the verdict, and decided that the bulk of authority was that in such a case the Verdict should be set aside, The Police Court Crowded. A HARD TIME FOR PRISONERS IN THE STIFLING CELLS. During the forty-eight hours ending at 8 o'clock this a.m. the police made 140 arrests; 67 were of white persons and 73 colored. Many of the arrests were for drunkenness, and the prisoners were re- leased when sober. In the first precinct the oM- cers made a raid on vagrants and persons Who loat about the “Division” and saloons and arrested twenty-four such suspects. ‘They were taken to the Police Court Uns morning’ where they were charged with being vagrants and suspicious char- acters. Some of them were committed to the farm in defanlt of bonds and others were released on their own recognizance. Wesley, Albert Kidwell and Alfred for the murder of Geo. Wurtenbaker at St. Asaph’s Junction on the Sth of July last, was called in the Corporation Court, Judge Meade, this morning. District Attorneys Marbury, of the city, and Clements, of the county, and Col. F. L. Smitn, attorney of the Pennsylvania Railroad, ap- eared for the prosecution, and Messrs. S. G. rent and J. H. Greene for the accused. The case Was met on the outset by preliminary motions. When the jurors were called, a special venire of twenty having been summontd only nine jurors Were obtained, all the others having expressed opinions or being otherwise disqualified. A sec- ond venire of twelve was orde! ‘but before the Jury was obtained the court took a recess until B o'clock tts afternoon. A Lrrtie Rror.—A melee that threatened at one time fo be a riot occurred near the (ano. yes- terday afternoon about 5 o'clock. ‘Ive small colored boys were bathing on the river shore in full sight of many residences, and Officer John Lawler, being called upon obtained the help of some citizens, and after a Ifttle chase captured the entire party. By this time the mothers of the boys appeared on the scene and attempted to rescue the lads. There was a struggle, but Justice Fair came down from the highlands with a posse, and all the boys and one of the most violent of the women were carried to the station-house. CoxporaTion Covrt.—The Corporation Court, Judge Meade, to-day took up criminal business again. At its last session, Saturday afternoon,the unlawful detainer case of the corporation against Mr. Ed.
