WEST ASKS TO HAVE HIS TRIAL POSTPONED, AND SAYS HE IS GETTING TESTIMONY THAT HIS SIND WAS APFCTED. ‘This morning, In the Critainal Court, Judge Mac- Arthur, the cases against John L. West, the col- ored ex.clerk of the land office, charged with housebréaking and assault and battery with in- tent to commit a rape on Mrs. M. J. Page, were called up, and his counsel, Messrs. W. A. Cook and D. E. Cahill, made a motion for 4 postponement. The affidavit of West was presented stating that he could not with justice to hitnself go to trial on the 17th Inst., because of the depositions which are now being taken at Columbia, S. C., and Lynn, Mass. He gives the names oi 'a number of wit: nesses, and states that he expects to show by thelr depostiions that his mind has been affected from sickness. District, Attorney Worthington submitted that the defendant had been employed in the Interior department, and objected to a continuance on the affidavit. He submitted, however, that the as- signed cases were crowding each’ other, and it Would be well to rearrange the cases of Walker, West and Whitaker. He asked that the West casé taken up next Monday.
