In the test case of the District against Thos. E, Waggaman, In the Court in General Term to- day, the District was sustained, the opinion being delivered by Judge James. The District Jaw requires semi-annual returns to be made by the real estate agents to the collector of taxes and that the license tax be imposed, and a md was given for the performance of this duty. The District claimed $1,000 for a failure to comply with the law. The defendant claimed that the law had been repealed, and that the bond was inoperative. The court holds that the law has not been repealed, in so far as it im a license tax, and’it was a perfect ‘obligation to all interests of the District. ———— Not a Partner of Squi DECISION OF THE DISTRICT SUPREME COURT IN THE CASE AGAINST DISTRICT COMMISSIONER EDMONDS, In the Court in General Term today, in the case of Jesse B. Wilson, receiver, (in the case of Crawford et al. agt. Squier) agt. J. B. Edmonds (Commissioner of the District of Columbia), the decree of the court below dismissing the bill was affirmed, Judge Merrick delivering the Opinion of the court. ‘The bill_ was brought to flake Edmonds a partner of Squier & Co. and tomake certain pay accounts available assets of the bank. ‘The court, however, held that Mr. Edmonds was not a partner and that therefore the papers taken ‘fom tho Tank are, his per. aor roperty. An appeal to the Supreme Court bf the United States was mov allowed. ———-_—__. The German-American Bank Cases. ‘THE BENCH WARRANT AGAINST MR, HITZ WITH- and DRAWN. Mr. John Hitz, who (with C, E. Prentiss) is in- Gicted for making false entries, &c., in the books of the German American National bank, and for whom a bench warrant was issued last week, was in the Criminal Court to-day with his counsel, Mr. Wm. B. Webb. ‘The district attorney called the attention of the court to the case, and stated that he wassatisfled that Mr. Hitz had not endeavored to evade process and he now asked that the beneh warrant be with- rawn, Mr. Webb said that the whole difficulty seemed to have arisen throurh @ misunder standing with his (Hitz’s) counsel; that he had left the city, but as soon us he léarned of the action of the court he had returned toits juris- dition. ‘The bench warrant was withdrawn. ee Charged with Conducting = Gift Enter- prise. HER ASSAILANT COMMITTED To JAIL, IN DE- FAULT oF $1,000 BAIL. Noah Burke, colored, was in the Police Court to-day, charged with assault and battery with intent to kill Mary L. Fortune, a colored woman who lives in O-street alley. ‘The ease was cop- tinued indefinitely, and he was committed to jail, in default ot $1,000 bail. It appears that Burke's wife, who is separated from him, lives in the house of Mary Fortune, and Burke had been told to keep away from the house. On Saturday night he went there, ‘and a disturbance followed. Burke left the house. but returned shortly fverwards armed with anaxe. He remarked, “ You are going to have me arrested, are you?” and, raising the axe, dealt Mary @ blow over the lett eye, and she fell to the floor. Burke then left and washed the blood off the axe. The wounded woman ran to the sixth precinct station. Dr. Taylor arrived at the station in time to stop the flow ‘of blood and save the woman's life. She was then taken to her home, in O-sireet ailey. Woodford, a Treasury clerk, left his home, No. 40 Detrees street, last Monday, and as he has not been heard from since; his taunlly reported the matter to the police Saturday night. Before he left home he informed bis wife he was going ona hunting expedition to New York, but he did not state when. One ot his friends stated that he went fishing on Monday. The lecture room is 52 by 76 feet in size, and will accommodate a thousand people. The chureh building which, it is thought, will be completed before next spring, is 80 by’ 127 feet, and will cost abont $75,000.
