HOW FAR A MAN MAY GO IN PROTECTING HIS PROPERTY. The case of James Lindsey, the owner of a melon patch, near Bennings, and his employe, Charles Howard, charged with assaulting Geo. Carr, colored, on Sunday last, was on trial be- fore Judge Snell this morning. Carr testified that last Sunday he went out to Bennings look- ing for work, and met two white men, and one of them told him that the melons on @ patch near by belonged to him and he would pay him a quarter to go after them. He went, and Lindsay came up and strick him several times with a stick, while Howard kicked him. Wit- ness went with his assailants to the two men who sent him after the melons, and they agreed to pay the damages. Lindsey and Howard. however, again attacked witness, and Howard struck him on the head with a stone, after Which he remembered nothing, | Witnesses tes tied to finding Carr lying across the railroad track in an insensible condition. ‘The delen- dants testif_ea to astaujting Carr because he was found in the melon patch, The Judge said many persons have an idea that they can beat or shoot a man because they catch him in thelr melon patch, but that is & mistake, Even an officer-of the law has no right to shoot @ common thief for committing a misdemeanor. If a man is under arrest and escapes, an officer under some circumstances might have aright toshoot. A person unques- tionably has a right tosboot a burglar whom he catches in bis house in the night time. Of course the defendants felt that they have been out- raged, but they must not go too far in punish- ing the offenders, A fine of $10 each was imposed. eee Local Notes. ‘The water from the pumps at the corner of 6th street and Pennsylvania avenue and 7th street and Pennsylvania avenue, has been tested at the instance of Health Oificer Town- shend, by Dr. De Smedt, chemist, who reports that If is good iron mineral water.
