REMARKS OF JUDGE SNELL ON THE CASE. The case of Summerville Nicholson, the young man charged with the grand larceny of a gold watch and chain, valued at $43, from his companion, Charles C. Stouffer, a Pension office clerk,on the 25th of July, 1882, which was continued in the Police Court several days ago to hear the testimony of Stouffer, was called up ay. When at the corner of 9th street aud Grant Place Nicholson asked him the tline, and it was then that he missed his watch. The next morning witness went to see Nicholson and asked him about the watch. He said he knew nothing about it. Nicholson, be said, weut with him to police is an iy 1 | headquarters to report the loss, “What was his condition?” asked the Judge. “We were both tight,” answered the witness, “but he seemed all right the next morning.’ “Was he in a condition to know whit he was doing?” the judge asked. : Abel sober enough to get home,” respended Stouffer. ‘The question is under what circumstances did he come in possession of the watch?” con- Unued the judge. “Did he see the watch when it was dropped? Was he in acondition to know what he was doing? Did he plek ltup with & felonious intent? The watch was found in Nic- holson's house, not concealed, und was kept in the family for about two years, I will dismiss this case. yf can take it to the grand jury if you ehoose, ‘Tam satistied there can_never be 4 conviction of larceny.
