Thursday in the General Term of theSupreme Court of the District a decree was made in the case of Keefe agt. Bramhall and Baker, trus- tees, and the heirs of James S, Stephenson, in favor of the defendants. The plaintiff filed a bill in equity in September, 1883, to remove a cloud from his title toa loton D st. northeast, between 3d and 4th streets, and for damages. ‘The bill claimed that the defendants were not the heirs of Stephenson. After the tak! of testimony the plaintiff's counsel, Mr. J.G. Bige- low, admitted by stipulation that Stephenson died siezed, and that’ the defendants were his heirs, Judge MacArthur, at the hearing in last, dixmissed the bill,and plaintiff took ‘an appeal to the General Term, the case to be heard on its merits, + After argument by J. G. Bigelow for plalntiff, and Judge W.Willoughby for defendants, Judge Wylie delivered the unanimous opinion’ of the court. Some extracts from the opinion will be of interest: “This is a bill to quiet the title to the west haif of lot ‘, square 750. The plaintiff claims under tax title and some mesne convey- ances. The defendants claim under the real title. The property was vested in James 8. Stephenson in bis Iifestime, and he died about the year 1811, siezed. The defendants are all heirs-at-law of James 8. Stephenson. It 1s a claim, then, of the party who holds the tax title under the corporation of Washington against os who hold the other, the real title. “This piece of property was sold in the year 1827 tor taxes for 1824,1525 and 1826 for $1.12.
