Mr. Charles L. Jones, of the Treasurer's office, was called to testify a8 to the payment of one of the checks to Mr. Drew, but had no independent recollection of making such paymentaside from the handwriting on the check showing that he had probably pald it. Dr. P. 8. Wales, U. & N., was called as a witness, for the prosecution, and téstifled to the routine of the bureau of medicine and surgery in ordering goods and making out vouchers for payment. He Temembered that Mr. Drew competed once success- fully for a contract for supplying ‘This con- tract amounted to about $1,000. He had seen Mr. ‘Drew at the office at that me. ‘There was no law for purchasing goods except by contract, but in cases of emergency the bureau authorized such purchases to snail amounts. ‘When the bilis and vouchers were presented to the Witness Mr. Moore objected to the introduction, of these bills, and made an argument w: rt there was variance between the proof offered ‘and. the indictment. ‘Judge Wyile overruled the objection. ‘The witness said he had never contracted with ‘Drew for the goods named in the bills, and such goods hind never, to nis knowledge, been’ delivered, ft delivered they would have gone tothe naval laboratory in Brooklyn. He had never knowingly approved these bills. Witness’ signatures on the vouchers might be genuine, but if so, they were ob- tained by fraud, He explained how such a fraud might be committed by pasting a portion of a bill on after his signature had been obtained, or by folding over the bill when nis ‘signa- ture Was obtained, or as the vouchers were signed in tripiteate, and the witness examined only {the top one, by introducing. the fraudulent blll, OF ‘a blank bill, underneath. The bills in question were unusually linge. ‘The general run of them did not exceed #50.
