Judge John J. Key appeared before the Springer committee to-day and testified that he was attor- ney for J.B. Colgrove in the star route cases. Judge Key stated that at Colgrove’s suggestion he went to see Mr. Merrick to explain to him that he believed Colgrove innocent, and to protest against his indictment, Mr. Merrick referred witness to ‘Mr, Ker. Witness went tosee Ker; told him he ‘was satisfied that Colgrove was innocent and ought not to be indicted. Mr. Ker replied that he didu’t Delleve those men to be innocent; that he had proof of their guilt. Witness replied that Boone, whom he knew had attempted to blackmail Colgrove, had testified agalnst Colgrove, and he cautioned’ Ker that he could not credit Boone’s evidence. Mr. Ker declared that Colgrave ought to make restitu- ion to the government; ought to restore money he had improperly got. Witness reported this to Colgrove, who declared that he had never obtatned adollar Improperly, but as an indictment would ruin him, he would rather pay money to the ‘gov- ernment’than be indicted. Witness advised not to do anything of the kind, as such payment ‘would be an indirect admission’ that he ob- tained money illegally. Next day Colgrove sald he had talked with his wife and had decided not to pay any money to the government: to, submit, to rial fist. Witness reported this to Mt Ker, who replied that Key had misunderstood him: that he did not care for money restitution, but 1t Colgrove would testify to all he knew «nd ‘enable him (Ker) to convict the othe drop the matter. Witness replied should not turn informer.
