A CHARGE OF ASSAULT WITHOUT INTENT TO KILL To-day, in the Criminal Court, Judge Wylie, the case of Charles Schmidt, charged with assault and battery with intent to kill Melville D. Washington, February 6th, in the house of Mra Caton, on 185 | street, was called—Mr. Coyle prosecuting and Mr. J. A. Moss for the prisoner. The accused ts a Ger- man baker and shoemuker, and the testimony was Wo the effect that he and his wife had separated, and the latter went to Mrs Caton’s, and on the night in question Washiugton Was in the house when Schimidt came in and cut Washington, making: a wound on his face. The defense showed that Schmidt and his wife took rooms at Mr. Marques’, Schmidt being engaged at the American house, and that Washington visited Mrs. Schmidt at 6 o'clock in the morning, and was ordered away by the husband. ‘T'his occasioned a vere and Mrs, Schmidt went to her aunt's, where Washingtou continued his visits, Schmidt testified that he did not intend to kill Wasiington, who, about October last, commenced to Visit his wife, and he forbid him coming to tite house. He introduced himself us a Cuban, and wit- ‘ess (did uot Know that his name was Washington, or that he Was marricd, ull January. On the day in question he saw Washington about going to see his Wife, and he warned hi to keep away and at- tend to his own business, and he then went down in the city and came back and heard Washington and his wife talxing and it made him mad. After short arguments the case was given to the Jury, with an intimation from the court that the ‘question was whether it was a case of assault and battery or assault with intent to kill, The jury, in about twenty minutes, rendered a verdict of guilty of assault aud battery” ‘The court said that under the circumstances a good deal of allowance should be made for the de- iendant. Had Washington been caught in the act and Schimldt bad shitty him he could not have been convicted. ‘There was every indication that the suspicions of Sclinldt were weil founded, and he had good cause for being indignant.
