THURSDAY..............0ctober 23, 1883. 2d Edition. Lalit Telarams to The lar ‘Walsh Against Brady. A STAR ROUTE CaSE IN NEW YORK—SUIT ON BRADY'S ‘NOTES. New Yorx, Oct. %.—One of the star route cases haf ese as the supreme court before = Barrett. It was an action brought by John Walsh Thomas J. Brady, of star route fame. ‘The matter came up on a motion to vacate ‘an order which had ison siento for the examina- peared, with Judge Wilson ot Wasningeon is sabe ru of Washin; Port of'the motion, and E. H. Grandin Sppceed It ‘The suit was based upon a claim of about $42,000. ‘The order was asked to be vacated on the ground that there was no necessity for the examination of Brady; that Walsh had testified fully and in detail concerning the alleged causé of action and the al- Jeged existence of certain notes in the star route trial in Washington, and hence he was perfectly aware whether or not he had a cause of action. ‘The claim ts alleged to be upon certain notes made by Gen. Brady. In opposition it was stated that Mr. Walsh was not aware of the contents of these notes, and that the knowledge of their contents was Recessary and material to enable him to frame his complaint In answer to the court Mr. Grandin said that these notes were executed and endorsed by Gen. Brady, and that his client was deprived of them by force and fraud. Mr. Walsh now sought to ex- amine Gen. Brady a3 to the contents of these Papers bofore trial, so that the examination may be used when the case 13 brought to trial. JUDGE BARRETT'S DECISION. Judge Barrett after examining the papers decided that the order would have to be vacated because ‘the affidavit did not state that the plaintiff needed to see the notes, neither did It show that the evi- dence of Brady’ was materiii and necessary to enable Walsh to frame his complaint. He there- fore vacated the order, In connection with this suit an order had also ‘been obtained to examine Senator W. P. Kellogg as es 80 that his deposition could be used upon e Senator Kellogg says in his affidavit that Walsh was active ia peas his in- ictment against him, charging — him with having received compensation from J. B. Price while he was U.S. Senator. He states that the order for his examination hese was not obtained in good faith, but. was intended to preju- dice him in his trial on the indictments. Counsel contended that there was nothing in the affidavits of the other side to show what the object of the examination as, and no complaint had been fled. judge Barrett, after lool through the papers, announced that th s was sor and vacated this ordez ————— Shot Dead. MAYO AND NAVAL CON- STRUCTOR VARNEY—COMMENTS OF SECRETARY CHANDLER. Secretary Chandler has made public the defense of Commodore Mayo and Navai Constructor Var- ney against the charges of Mr. Dezendorf. Com- modore Mayo contradicts the ex-Congressman point blank on most of his allegations, saying that ‘he did not it leave of absence to empires ex- cept as by Secretaries of the Navy, and engaged no men except as their services ‘were needed. Constructor Varney ges more into detafl. is dentes that he permitted a false muster for political imade appointments to hone, le political speeches at roll-call or increased the force before election. | Mr. Varn ains the sums spent on repairs y Statement that they were begun before ‘he tool, and were increased by insufficient appro- priations, frequent stoppages, transfers of force to ‘Work on other vessels and to alterations ordered by the bureau.” THE NORFOLK NAVY YARD MANAGEMENT NOT EN- ‘TIRELY SATISFACTERY. A ew brokers have paid $100 cash for licenses under clause 11 of sec. 21, but nearly all of this class have taken advantage of the pro- viso in that clause and paid as bankers as low as from 50 cents to $10, when it seems evident that this proviso was intended for the benef of “banks thelr regular ‘sec. 21, INOREASE OF LIQUOR TRAFFIC. During the last license year there has been an in- crease of 88 bar-rooms and 42 wholesale liquor dealers licenses over the previous year; 46 bar-room applications have been rejected, and their deposits have been returned as demanded. If the liquor license, wholesale and retail, was made consider- ably larger than now exists’ it would probably re- sult in the decrease of the number of dealers and bring more revenue to the District. The time of icense tor 18 continuously occupied with the Uquor board, of which he ts a member, and the District is losing much revenue for the want of an assistant inspector to bring in delinquents.” REAL ESTATE ASSESSMENTS. Inspeaking of the work of the board of assessors, he says: “Nine hundred and thirty-eight appeals were presented, each one of which was referred to a committee, and had due consideration; 282 of them were allowed, and each applicant was notified by letter of the action of the board in his or her cases. In addition to the above tle lem of its own motion, made 2,547 changes the orlgi- nalreturns, and the result is an increase of about a half million dollars above the ate Value as returned by the assessors. The time allowed for ‘the assessment was too short, and the assessors’ men too much hurried on that account so that the assessment 1s not as satisfactory asit should have been. I recommend that, at the ext assessment, the number of assessors’ be re- Ke @uced—each of them to have an assistant, who will ‘be competent to aid in measurements an up the correctly—so that a more correct exam Ration may be made as to values, locations, &.; they should also be continued, as far as practica- ble, for future assessments, that they may correct ay, errors of judgment, &., in their previous returns.” ‘THE PERSONAL TAX. Speaking of the personal tax he says: “This law meets with great opposition in the District of Co- lumbia. Those persons who make returns accord- ing to law are by no means numerous, and they Teasonably complain that they are compelled to bear an unequal burden. It Sometimes happens That under this law property pays as much as436 percent per annum laxes—viz., one on real es- tate, again on a mortgage tn the hands of # lender, and ‘once more in meérchandize purchased by the | proceeds of the loan. ‘The rate of interest paid by he government is Jower than ever before, and ioney can be loaned here as low as 6 per cent per Annum Tt is unreasonable, now, to expect, capt. talists to pay yy per cent on’ this reduced Income.” GEQRGETOWN PLATS, On the subject d? Georgetown plats he says: “I suggest that all future subdivisions he required to have new designations by letters or figures; so that the original lines and_ numbers may be obliterated, unless put in some other color; and I further sug” gest that, if now practicable, the squares in Georze- town be changed from No.1 and upwards to 3391 and upwards, the number of squares Deing 1170 in Washington and in Georgetown 131, 80 95 to avoid | confounding these small numbers ‘with those in | Washington, and to consolidate the Washington and Georgetown numerical and tax books.” a ses. ce District Government Affairs.
