He is also charged With disregard of the rules and favoritism in other oases, ‘Tne News has been recetved of the death in Caracas, Venezuela, of Senor Simon Camacho late minister from Venezuela to this country. It will be remembered that he happened to be an eye witness of the assassination of President Garfield and gave a graphic description of the Scene as one of the withrwes for the government in the Gufteau trial, Senor Camacho had an ad- yenturous life, having traveled widely and pass- ing through ‘one very exciting shipwreck. WHAT GENERAL BENET SAYS ABOUT THEIK LEGAL STATUS—THE TWO MAIN POINTS IN THE CASE. “Wnhat action will be taken In reference to the letter of the District Commissioners asking thi the legal status of tho District militia be destined?” asked a Srar reporter of Gen. Benet this morning. “Well, { can’t tell,” was the reply, “for I have not yet given the matter serious attention. Next ‘week I will take it up and dispose of it, This let- ter was, without doubt, the result of a conversa- tion of one of the Commissioners wifh myself,” continued Gen. Benet, “and in making the custoi ary requisition for arms they very properly take advantage of the opnortunity to ask that the sta- tus of the District miiitia and their relation to it be fixed. ‘There are two main points to be di cided in this matter: First, the Comulsstone recognize that they have nothing to do with the mnliitia, yet, in issuing arm,eithe department only recognizes ‘the highest authority of the state or territory, the governor, but in the District of Co- umbia the Commisstoners. The Commissioners only make the requisition, therefore, a5 a matter of custom and conventence, and It ts very natural that they should want to have the District miittta legal'y organized. In the second place, there 1s an important question ratsed, which I should like to see settled—namely, whether tne supply of arms for the District, should come out of the annual $200,000 appropriation for the whole body of the | militia, a8 provided for in section 1661 Revised Statutes, or whether ‘all arms for the territories and for the District of Columbia shall be annually distributed in such quantitles, and uaier such reg- ulations, as the President. may prescribe.’ (Sec. tion 1667 R. 8.) It 1s claimed, you know, that the territories wero excepted from the laws governing the amount of arms distributed to state miliila, as the territories were on the dangerous fron- tier, and for this reason the atnount of arms was not limited, but left to the discretion of the Prest= dent. Baldwin, filed in the Equity Court, Judgo dames, yesterday by Randall Hagner, attorney, to show cause why the dismissal of an equity cause in which she ts complainant and L. M. Saunders 1s trustee, and others are defendants, should not be set as'de, Mr. Saunders repiles as follows: He says that on or about the 1st of July last a scheme was concocted on the part of two of the children of said Mary Baldwin to get Peas of her property, to the wrong and pre- judice of her other children, and to that end they Induced this old lady, now more than cighty Feats of age, to lease her old home, where she had ved more than fifty years, and kept her shut ap for a space of several week’ and would not permit her to return. and during said period they took into their confidence Randall Hagner, an attorney of this city, and as a result of their joint efforts a Dill was filed against Saunders, truatee, and five of her children, praying that the property held in trust be transferred in fee to her, but sald Dill contained ro charges of wrong-doing on the part of the trustee.
