PROCEEDINGS IN THB CIRCUIT COURT TO-DAY. To-day, in the Circuit Court, Judge Macarthur, the case of the National Bank of the Republic agt. Bigelow was heard, Mr. R. K. Elliot for plaintiff and Mr. W. B. Webb and Mra Lockwood for the defendant. The pending motion was to strike out the judgment taken some weeks ago for want of pleas being flied in time, and MF. Elliot stated that he would consent to the Judgment being stricken out, provided that the defendant would come in within thirty days for trial He had made an investigation ag to the defendant swear- ing to the plea in which he says “he is not in- debted to the bank,” and he had ascertained that this clause was placed in the plea at Mr. Bigelow’s dictation, and this was a perjury. Mrs. Lockwood replied, with ‘some feeling, that they would show that the perjury wason the other shle. The court directed that the judgment be stricken out, the case to go on the calendar. The other case was then called, this being the action in the first discovered defaloation in which the pleadings were not complete. Mrs. Lockwood claimed that this jount had been paid; that the ‘bank claimed $8,000 and had been paid §10,000. Mr. ot said they were not here to try the case, and if Mrs. Lockwood would agree to the case being consolidated with the other, and set down for trial, it would be agreeable to him. The court ted the perfection of the plead- ings, the consolidation of the cases, and that they’ be placed on the calendar. . Commitments to the Penitentiary. John Taylor, alias Thaler, against whom a war- Fant was sworn out by Mrs. Carl Yobst before Jus- tice Walter last Thursday, as mentioned in THe STAR, Was arreste’1 at the Pension Office, where he 1s employed as a watchman. He claimed that the charge was brought to blackmail him. Prose- cuting Attorney Moore this morning called Judge Snell's attention to the charge against Taylor. Mrs. Yobst, a middle-aged lady, was present in court in company with her husband. Mr. Moore stated that Mr. A. Cook sppenrot for the de- fendant, and wisned a continuance. He stated that he’ also desired a continuance, as the lady wasa German, and could not speak English, and he would have to get some one to interpret her testimony. Burgess was attacked by a man in dark cloth- ing about 1 6’ ck Sunday morning, on D street, between 1st and 2d streets northwest. The attack was made with a black Jack and Mr. Burgess sus- ned a severe cut on the back part of his head. , however, recovered hiinself and held on to his aseailant for a time, but the latter finally broke away and make his escape. The motive of the assailant 1s supposed to haye been robbery, as Mr. Burgess had previously had a $50 note changed at the Theater Comique, and it 1s believed this man followed him to get ft, even by murder. He is. known and will probably be arrested. —_— A CASE THAT STKONGLY APPEALS TO THE CHARI- TABLE.—The police report a case of great distress in South Washington. I haven’t got any key,” and Taised his foot’and kicked the door. ‘The officer put a charge of profanity against him. It was alleged that they bought articles of smatl value in the market, tendering the counter- feit dollars and receiving genuine money in change, One of the men carried the counterfeits while the other made the purchases. Mr. George W. Norr! a market dealer, suspected the men, follow them, and soon obtained evidence upon which he cuused their arrest by Policeman O'Netil. They had passed bozus dollars on Jacob Seibert, Louis Miller id Daniel Vozt. On the wayto the station Hill threw ten of the coin away, which were picked up by the police. ‘They seemed to be fresh trom the mould, and are well executed. Morgan and Hill Were held for the United States authorities.” Srontxa A STREET Can.—A burly young colored man, named Daniel Stewart, was charged before the Police Court this morning with profanity, and also with throwing stones, Samuel Swift, con- duetor of car No. 60, of the 7th street line, stated that last night the defendant got on his cir, and Was afterwards found tobe drunk and Iollinj around on the other passengers. He was put off at 7th street and the avenue, and then began to stone the car, breaking the windows and frighten- ing the passengers, because he was not allowed to return to the car.’ He was fined $5 or 15 days for cursing and swearing,and $20 or 60 days additional for throwing stone: a ‘Tue CoLor LINE IN MARRIAGE.—The case which involves the right of intermarriage of white and colored persons in Virginia, which ts forbidden by the state law, comes up before the U. 8.
