In the case of Conners the motion was overruled and he was sentenced to ten years imprisonment in the Erle county (N.¥.) penitentiary. In the cases a others the motion was aliowed, the court = that under an indictment for rape the Jury could not find suen verdict as nas been ren- dered. Mr. Pelham then moved that they be charged, and Mr. Taggart moved their recom- mitment for the action of the grand jury.
