REPORT OF JUDGE ADVOCATE GENERAL SWAIM THAT ‘MASON IS ILLEGALLY IMPRISONED. The case of Sergeant Mason, the soldier who shot at the assassin Guiteau, is again before the Secretary of War, ona supplemental report from. Judge Advocate Seneral Swaim, which was sub- mitted yesterday afternoon. ‘This sepors ie In tet ereace ta the petition filed, with fthe dent by, Mr. Bigelow, of Mason’s counsel, for the release of his client from the Albany itentiary, on the ground that he ts illegally confined: The petition Was in the nature of a writ of error. It * was referred to Judge Advocate General, together with humerous other petitions received by the President for the parton of Mason. It 1s understood that Judge Advocate General Swaim adheres to the legalopin- Jon expressed by him in his original report on this case, which was that the proceedings of the court- martial which tried Mason were irregular, and that his confinement under {ts sentence was {lle- gal. The cround taken by Gen. Swaim is that the act of Mason Ws not an assault with Intent to kill, as shown by the evidence; and further that if ft was an assault with intent io kill, 1t was not trlable by a military court for the reason that Ma- son had no legal charge, custody or control of Guiteau at the time.
