Jt Wylie answered to the end of the world, and if, with any degree of cer- tainty he was Satisfied’ that it was his, then he might take ft, Mr. Mitchell asked how it would be in the gase of money. Judge Wylie answered that money‘was an exception. It passes from hand to hand, and title goes with it; even in cases where cannot take It from an innocent holder, because any other rule would make trade unsafe; but each case of this kind must. be determined upon its own merits. Mr. Mitchell asked whether in the case of property found in the hands of a Pawnbroker that had been stolen, it was neces- sary to indemnify the pawnbroker for that prop- erty. Judge Wylie thought not, for the claim of the owner was Superior to that of the pawnbroker, otherwise it would be a benefit to pawnbrokers to | eneourage thieving.
