On the opening of the Criminal Court this morning it was expected that the star route cases would be called. Messrs. Shellabarger, Totten and A. B. Williams appeared for Mr. Brady; Judge R. M. Carpenter, of Kentucky, for ex-Senator Dorsey and Mr. Rerdell. ‘THE DEFENCE 4#KS FURTHER TIME. Mr. Totten stated that to-day had been fixed for the defendants to come in to plead or file any motion which they might deem necessary. The indictments were very voluminous and they re- ired critical examination. ‘They were unable to eed to-day or to inform the court what course they would pursue or what motions they would file: Some of the counsel had been indispo-ed— Mr. Wiison being sick—and consequently they had been unable to have a full consultation. Mr. Totten asked that the time be extended one week. District Attorney Corkhill remarked that Mr. Bilss was not in court, but he did not see why the c1ses could not go on. JUDGE WYLIE GRANTS A WERK FURTHER TIME. Judge Wylie ‘said the request for delay was a | Feasonable one, as the parties were under bail, and he granted one week's further time. CASES DISMISSED BY JUDGE SNELL FOR WANT OF JURISDICTION. ‘The charges against Richard T. Hudson and He- zekiah Waple, commission merchants on Loutsiana avenue, of selling oleomargarine not, properly 1a- belied, (which cases were referred to at length in yesterday's Stax,) were dismissed this morning by Judge Snell, who sald that_he had made a careful examination of the statute, which provides that persons offending shall be proceeded against. by indictment, and as this court cannot proceed by indictment’ the point raised by the defence, that this court had no jurisdiction in the matter, 15 sus- tained, and the case would have to be dismissed; but the prosecuting attorney could get a warrant against the defendants and take the matter before the grand jury. Mr. Moore, the prosecuting attorney, replied that If the case could not be prosecuted here he thought it would have to fail, because the upper court could not try misdemeanors by indictment that are not punishable in the penitentiary.
