MOTION FOR A NEW TRIAL OVERRULED. ‘This morning, in the Criminal Court, Judge Cox heard the mot.on fora new trial in the case of Jonn Donohue, convicted some months since of manslaughter in killing Mrs. Catherine Bailey February 13th, 1981, Mr.'T. F. Miller for the de- fence. It will be remembered that the parties vere more or less Intoxicated, In the house of Mrs. y, in the neighborhood of the Schuctzen nd Mrs. Buley was struck and her skull ctired. Mr. Miller clalmed that the testimony showed that if Donohue struck the fatal blow it was done in self-defence. He also claimed taat tae fatal blow was not struck by Donohue at all, but that the dauzhter, in the broil, struck her mo- ther with a brick—the missile, with blood and hair, being found in the room where the woman was found. He was satistied that on a new trial it ean be clearly established that this tnan 1s not guilty. ; District Attorney Corkhill sald that on the trial @ rung of a choir with the blood on it wus pro- duced, ang he thought there was but little doubt that the secused struck her. He thought the pris- oner shouid be thankful that he escaped convic- tion of munter. Judge Cox suld he could see nothing to change his mind, and he would overrule the motion.
