The confirmation of Judge Robertson, to be collector of the port of New York, involved more than the fitness of the man for the posl- tion. Over this nomination an important quesilon was raised as to the extent or limit ef the Presideat’s prerogative in the selection Of federal appointments and as to the proper application of the words ‘by and with the advice and consent of the Senate” in the Fed- €ral Constitution. Senator Conkling ratsed the issue, contending, in effect, that the clauze quoted from the Constitution invests a single Senator with anthority to advise and cons2nt. In the letter accompanying his resignatton Mr. Conkling says: ‘A Senator has his own respon- sibiity. He is amenable to his state and to the body of which he is a member.
