Tne defeace was Ubat the prisoner had been in America for some years, and, as people did there, carried a loaded revolver in a@ pocket in his trousers made on purpose, and so wore it at the deceased’s hou: onthe night of the eccurrence. — He took 0} his coat and was proceeding to undress when the deceased took the revolver from his pocket and said he was a fool to carry it, While his back was toward her it went off and he just caught her as she was falling. He discovered thay she was dead and he laid her down. All hts Statements were consistent with the fact that he found she had shot herself and went to her assistance, Several gentlemen were called who proved that the prisonr was siways in the bablt Of carrying 9 revolver in hts pocket. The examining magistrate said that in his judgment there was not only an enilre absence of any testimony on which a jury would Convict the accused of wilful mut der. but the evidence went to a very great e: tent in an entirely opposite directlon—namely, that the deceased was playing with the pistol and that she herself committed the act.
