BENJAMIN COUNCILMAN HELD TO BAIL, ‘This morning, in the Police Court, Benjamin S. Councilman, a white man, was charged with committing a rape on the person of a young white about 17 years old, named Isabella L. White, ' She testified that about 11 o'clock on the night of the 5th of this month, while com- ing from a picnic near Tennallytown, man in = wagon, ‘es threw her bmiyp in te wagon and outfaged her person. On cross-ex- munination the fact was elicited that she made no complaint to her mother until about a week afterwards; that her clothing was not torn nor disarranged, and no appearance of resistance was manifest. No other testimony wa3 of- fered tn the case, but the court thought such a grave charge as this should be further investi- ated and Sent the case tothe grand jury, fix- the bonds at $2,000, which were given, and Mr. Councilman was retoased. : The folowing additional statements were fur- nished our reporter by Officer Myers, who made the arrest:—Miss White—the victim—ia com- pany with her brother Charles and sister Lizzie, attended a picnic on the 5th instant, at Green- wood, the mother cautioning them to return home at least by ten o'clock. A storm arising, they were put by their brother in the Rockvili¢ stage to be taken to their home in Tennaily- town, he remaining at the pien! The girls upon’entering the stage found it crowded, and several drunken men in it, and decided to walk In preference to peng io such company. The girl says she made every outery aad resistance possible, ‘The nearest house to the place of the outrage is said to be about four hundred yards off, and about @ half a mile from Tennaliytown.
