Geod for the Railroads and Bad | for the Country. ‘The Supreme Court, by one of its decisions on Monday, overruled the decision of the Inte- rior department in the famous Dudymott case, 80 far as the latter decided that the mortgage Of the raflroad lands was not a disposal of them under the granting act. The grants to certain railroads were made by Congress with the condition that if, within three years after the completion of the road the land was not sold or otherwise disposed of, it should become subject to pre-emption entry, and the proceeds of this disposal of the land at $1.25 an acre should goto the railroad companies. What ands the companies had not sold within the three years limit they mortgaged. The Interior department decided that mortgaging the lands Was not such a disposal of them as would pre- vent entries by settlers under the pre-emption and homestead laws, in cases where the three years limit had passed. The Supreme Court takes the opposite view. The ratiroads are confirmed in their right to sell at their own Fates the land granted them, and are not compelied to dispose of them at $1.25 an acre. As hundreds of thousands of acres of land are affected by the decision, which will bring when sold many times the $1.25 per acre to which price they would have been reduced had the Dudymott decision been sustained, it is evident. that the action of the Supreme Court in this matter is of great importance both to the ratl- Toads and to prospective settlers. The victory of the former isa discouraging defeat to the latter. While money ts put in the pockets of ‘the railroad companies, the interests of the na- tion as a whole which require that every facil- ity should be granted to immigrants to the end ‘that the territories may grow in population ‘and wealth and become states, will not be ad- vanced by the fact that immense tracts of de- sirable land are held by corporations to be sold at their own terms or to be reserved from set- ‘tement altogether. —_—_—_\_—--______ ‘The Baltimore & Ohio Ratlroad Company deny ‘that thty are seeking a lease of the Loulsvitle and Nashville road on a guarantee of eight per Cent. interest on the stock. ‘The New Yorkers are yet wrangling over the ‘question of the site of the proposed World's fair, and, altogether, their proceedings thus far are by no means encouraging as to the success Of the exhibition. The deduction trom these expressions of opinion is that 75 per cent. of the republicans Of that state are for Grant, 15 per cent. for Sec- Durne and Garfield.
