Durant agt. D. W. C. Giddings, of ‘Texas. for breach of oo < Biichorri eres being in on of bonds belonging to the eof Texas, th platntiffs were employed to collect them under an agreement that they should receive twenty percent of the amount recovered, and defendant was also employed. It ts charged that the latter collected 240.12. but failed to retain the twenty per them, and they therefore bring suit to $70,000. The questions tnvoived are (fi defendant, on the ground of pubile policy, empt from the suit, and (second) whether, as a member of Congress, defendant was exempt from service. Wells. jr., Redington, Judge Smith and the District attorney, and a charge by Judge Hagner, and they retired at 6:15 o'clock.
