Solomon appeared a’ Police headquarters this morning, to Detective Miller. He said that a dandy- looking colored fellow called at his house last faturday and asked if he had any rooms for rent, and receiving a negative reply, said he would cali next day. He came on Monday, about 11 o'clock, and entered into a conversit- ton with Solomon, stating that he was a doctor from Savannah, Georgia; that his father was a slave, but an uncommon smart man, and tha! he made a great eal of money by ls learning, accumulating much property “ai ones, Which, at his father’s Eeath, had been left to him; that bis father had instructed him in al! the knowledge of making mone; and how to impart luck to others. A NEW TRIAL GRANTED. ‘To-day in the Court inGeneral Term Judges Wylie, MacArthur, and Hagner, the latter de- livered the opinion of the court in the case of S. Strong agt. the District awarding a new trial. ‘This case has become somewhat noted in con- sequence of the ullar circumstances sur- rounding its trial 'r, before Judge Humphreys. Judge Hagner stated that the opinion was concurred inby the Chief Justioe as well as those setting with him. They considered the motion for a new trial, in arrest of judgment, the motion to strike out, judgment, &c. In re- gard to the motion for a new trial, the prin- cipal point was whether or not the jury was | properly constructed for the purpose of trial | We Fecounted the calling of the case in the Clr- | cuit Court in May last, its postponement until July 17th, when the jury was impannelled and respited Untl September 10th, when the court was _reconvent @ juror excused, another sworn in his place and the next day like action was taken with another. This made ten old jurors and two new ones, and each was sworn separately. They had great doubt if a jury could be thus impannelled, for if it was so, then they might say that one juror from the May term and eleven summoned subsequently would constitute a legal panel. Then the jury was sworn and motions were made to strike out cer- tain exceptions which were allowed in some cases and overruled in others. A mo:ion was made to withdraw a jurorand continue the ease, which was overruled. Then the judze reconsidered his ruling and permitted the ex- ceptions to be amended, and the other side asked for a continuance to prepare an anse which tue court refused, and directed the case to proceed. O'Brien, Wao was a few years ago senten be hung, bat subsequently sent to the Aiby penitentiary for lite, from which he was par- doned a fev months since, which child was taken from the custody of the grand noriier under habe i corpus proceedings and placed in eustedy of the mother (Mrs. Hazle) a fev days since, the mother has entered an ap- peal to the General Term.
