CHARGE OF CONSPIRACY TO DEFRAUD THE GOVERNMENT. F. A. Sawyer, W. T. Haines and W. | Brooks, under indictment for conspiracy to | defraud the government, were also. present. The trial of this case had been fixed for Mon- day next. n thecase of Sawyer, Haines and Brooks, ex-Senator Carpenter and Mr. Cook, of coun- sel for defendants, filed affidavits for a contin- uance for thirty days. The court declined to grant the order. A NEW TRIAL OF THE RAY-CURTIS CASE RANTE! 6 E The case of Ray, alias Curtis, &c., was called up,and Mr. Corkhill was about to commence his argument on a motion for a new trial, based principally on the allegation that the jurors had in the jury room a copy of the Re- publican containing the evidence. Judge Wylie said that it was not necessary to fnrther argue the matter, as the affidavits satisfied him that he ought to grant anew trial. The twelve jurors had made affidavits, and he must say that they were a remark: able collection. He no’ doabt but that each juror stated in his affidavit what he believe to true, but nearly all of them testified to a different state of facts. There were two who agreed that the per in question (the Republican, of the 8th, most inflammatory article, calculated to influ- ence the minds of the jurors.) was taken into the jury room before ‘a verdict was agreed upon.and it was read by some, and in the presence of others. Most of them say that they had made up their minds before this, and some Say that their minds were made up be- fore they left the jury box. Yesterday, after our report closed, Sergeant J. E. Muihall—appeal from a $10 fine in the Police Court, for assault on John Toomey— was tried. The prosecuting witness said that he was returning froma pleasure excursion tember 2, 1977, and was very drunk, when the defendant came up behind him an struck him on the head with his baton, rendex- ing him insensible. The testimony of the de- fendant and a number of other withesses went to show that Toomey was behaving in an out- rageous manner, and that it took six officers to take him to the station house. Judge Wyli in charging the jury, said that police officers must be protected, and the prosecuting wit- ness had evidently been behaving like a fu- rious beast. The jury found a verdict of uot guilty.
