A. Boss was charged by Mrs. Johrgon pretences in representing hiraself constable and obtaintug from her $4 as charges, alto @ note for colle Watch, which bad been left as colicteral, and which he was to have appraised. Mrs. Jolin- son, the complainant, testified that Mr. Boss took the fee ou the pretence that he was a col- lector, and was entitled to it. For defence, Mr. Peibam testified that Mrs. Johnson em- ployed witness to reenver this property. As er attorney, Witness applied to Mr. Boss, who taid he would give the watch and note to Mr. Sprague; that several threats had bean made by Mrs. Johnson and her lawyers, and he did not intend to be frightened by any of them. This was all witness had to do with the maiter. Charles 8. Boss testified that he Was present at an interview between Mrs. Jobnéon and Mr. W. A. Boss, when the latter tendered the note and watch to Mrs. Johnson, which *he refused to take, expressing her de, sire that defendant attend to her case, and make the collection; she, at the same time, complained that he had not made the collec- tion promptly. Mr. Boss asked to make a staternent. and said that he was appointed a constable in 1851, and had never resigned nor bad removed, but for fifteen years had not been acting, having employed bis time in attending to minor cases befora justices as counsel, and so help him God, in this case, the word constable was not used. Tue court remarked that there was no proof that he had re presented as a constabie, and dismissed the case.
