It will be seen by our telegrams that Carl Schurz and ex-Senator Henderson, with other leading ‘public men of the west, have united in a recommendation t the whole matter of dealing with the electoral vote be turned over from Congress to the Supreme Court of the United States. An amendment to the constitution ling this to be done constitutionally sted, be ef- feeted with const e85,a5 most Of the state legislatures hold meetings next month. In several of the statcs, however, the legislatures bold only biennial se<sions. This is the eave in Maryland, for ins and the legislature of that state does not meet fora year. Under the emergency. however, if there was a general agree t as to the de- ineure in as sirability of this course, the non-meeting legislatures couki be convened in extra session. It ts understood that President Grant favors sending the matter to the Supt ‘ourt for decision, but whether in the shape proposed by Carl Schurz and the others, is not known (As ex-Senator Henderson is now acting with the demoeratic party, and Carl Schurz with the r publican party, it would seem that the recommendation in question is an impartial one, having no party bias. While there are many weighty arguments in its favor, the objection will no doubt be made to it that should the counting of the electoral votes, and the declaration of the result be perma- nently turned over to the Supreme Court, it would end in making the appointment to the Supreme beneh a matter of party scramble and intense party interest. to the detriment of its judicial, politically unbiased character. Ne Time for Blatherskite Politicians. In a temperate articie upon the situation in Congress, the New York Herald gives expres- sion to the views of the thoughtful people of the country in expressing the hope that the wisest and most pradent and aservative men will take command in both houses and in both parties, and that they will silence and keep in the background the noisy and injudi- cious. The country wants peace, and it cares very lit which of the two candidates be- comes president; it sees now all its interests injured, all its indust through adispute of the politi sult of which it bas no interest, exeept Uiat this re- sult shall be fairly come to, and shall not be liable to suspicions of fraud or wrong of kind. Now there is no such spirit among the people. who are tired of and want peace. A tremendous resp bility reste upon the Forty-fourth Congress and every member onght to fully appreciate it and weigh well his words and actions. The time has come for the order, “ Statesmen to the front and partisans to the rear.” Noting the patriotic suggestions made by the democratic journals to Gov. Hayes that he may end the present dispute by withdraw- ing in favor of Governor Tilden and thus place himself in history side by side with the immortal Washington. the Onio State Journal suggests that Governor Tilden should by all means avail himseif of this only opportunity to link the name of Tilden with that of Washington by withdrawing in Javor of Hayes. Very properly the President has treated the hue and cry about Ceesarisi with silent cor tempt. Had he believed that any consider- able proportion of the American people at- tached any importance to the charge against him he would doubtless have taken some means of putting in a conclusive disclaimer. Mr. Hewitt, the chairman of the democratic national committee. who has recently had @ conference with the President, while not feeling at liberty to enter inio the details of their conversation with reference to national affairs, is represented as saying that the interview was a very pleasant one, and that the President expressed surprise that any one should for a moment entertain the belief that he had any desire or intention of exceeding his constitutional powers as Chief Executive. The suit was brought to cover $5.000 trom the Continental Life Insursnee Company of Hartfont, that being the amount of a policy on the life of one George Hardman, whodie! in May, 185, two months after the policy was issuxl. The company refused to pay because Hardinan on making his application had given false answers to the questions of th» medical ex- aminer as to whether he hal ever suffered from any serious disease or mechanical in- Jury, whereas in fact two years previous he had been partially paralyzed, and that six months before he got his policy be bad had a severe attack of typhoid fever.
