Schools Not the Private Property of School Boards. The supreme court of Illinois has recently decided a case of considerable !nterest under the school laws of that state. Thecase arose in 1871, and was that of one Frances 8. Post, who resided with ner parents in the school district; was entitled to the benefits gad privileges of the public school; and was a pupil therein. The pupil was in @ class which, under the rules estabiished by the wchool directors, were required to study book-keeping as part of the prescribed course of education in the school. She had been directed by the principal of the school to get the books, but declined, because her parents objected to her pursuing that stady Sbe and ber parents were notified that ualess she complied with the requirements she ‘wovld be expelled the school. Subsequently she was forcibly expelled. She instituted an action of trespass against the directors and the principal of the school; and, on trial ta the court below, the jary fonnd a verdict in and assessed the damages at $135. westions raised by this case were , as involving the right of the Pehoui directors to prescriba a course of in. struction not expressly warranted by the Jaw; the power of the directors to enforce that study against the wish of the pupil and of the parents, the power of the directors to expel for any other cause than discdedieat, refractory, or incorrigibly bad conduct. They charge Mr. Conkling With the grossest selfishness in the matter, and allege that, so far from being sick, &$ reported, he is merely sourei and pouting ofer the facts that he himssif fatled to carry the Cincinnati convention in Jane, and that his favorite for the gubernatorial nomina- tion was badly beaten by Gov. Morgan last month. It is true that he is announced to deliver an address at Utica, his home, on the 3d of October; but this will not be accepted as very valuable evidence of the cordiality of bis support. By that tims the campaign in Obio and Indiaca wi}! be closed, so far as influencing public opinion, aad as tha resalt in those two states will sudstantially deciJe the Presidential struggle, it is felt that the republican party will be under no obliga- tions to Mr. Conkling should tt win ta the fight there. How far he migat b= helt re- sponsible for @ defeat, shoul that occar, is another question. Any way, he will proba- bly be invited tooccupy a back seat in the party hereafter. Under the constitution of the new sta‘e of Colorado the Presidential electors are chos2a by the legislature, and as the first legislatare is to be elected next Toesday, October 3d, that state will be first in the field to record its vote for President. Colorado has been claimed by both parties, and the result there Will be looked upon “straw” of some significance. Georgia votes oa the following day, September 4, for state officers, &c., and Will, of course, go democratic “by @ large majority.” eats The farmers of the couniry who have beet in the dumps because, though their crops Were good, the prices were too low to jastify the history of the United States, as the stud- Jes of the public schools, The law adds, how- ever, “that nothing herein contained shall prevent the teaching in the common schools of other and higher branches than those enumerated in this section.” The Court holds that the design of the law-makers was to give all the children of the State the op- portunity toacquire, freeof charge, a knowl- edge of the enumerated branches reqaired to be taught. All school regulations mast have this purpose in view; that is, the purpose of the law. The law clothes the directora with the power to expel pupils, but only “for dis- obedient, refractory, or incorrigibly-bad con- duct,” and this forfeiture of school privil- ges can only be enforced, and tne right lost after all other reasonable means have fatled. The Court, waiving @ decision woether the directors may compel the study of all the enumerated branches, meets the other ques- lions emphatically thus: “The question here | servant whether the power has been granted the directors to compel scholars to study other and higher branches than those enamerated in the law. it is obvious to the minds of all that the gen- eral assembly did not intend toclothe the school directors with power to erect and maintain seminaries, academies, colleges, or universities, and compel the teaching of the regular course Of studies usualiy adopted by those bodies. “The attempt to exercise such power Would be futile. It would bankrupt the ple, fail to impart the education desiga aed to conferred by such institutions, and would not, it is beileved, material standard of education amo: the great body of the people, as only a small number have united the <a ‘@nd inclination to ac- quire such a 11 education. We presume that pone would contend that the [nen to teach otber and higher branches could be tortured into the meaning that !t embraces ibe courses pursued in such institutions. The tendency to cripple the com- mon school to build up higher branches of education is general, and as the Chicago Tribune well says, in commenting upon this case, lo encourage or promote it is to weaken and destroy the common school. The schools are the ty of the public, intend: ed for the free instruction of the children who at: tend them, as a matter of right and not of form, and any rule intended or having the effect to exclude a eniid Is @ direct violation of the Fpirit and letter of the law.” The Chicago Times in commenting upon the decision characterizes it as a wholesome one; says that by It “school officers are re- minded that they have deen getting above their business,” and that “it settles whether parents have any rights in directing the ed- ueation of thetr children that schoo! officers &re bound to respect.” It will doubtless strike our readers how- ver, that the grievances experienced in Tilinots at the hands of bumptious scnool- boards who “magnify their office, and forget ‘that the schools are pot the'r private prop- erty” are trivial compared to those inflicted upon the people of this District by our present school board. The people of Illinois can rid themselves of an objectionable school board at the end of acertain term, but the men who have got control of our school board—imported from Chicago and the Lord Bnows where—have fastened themselves Upon the shoulders of oar people with the Pertinacity of the O'd Man of the Sea upon Sindbed, and comineer over their victims, the parents and tax-payers with the cool in- solenee of officials in no ways responsible to them or capabie of being reached by them in Sy INSvner or form.
